独立青少年司法模式的应然废止:以美国实践为摹本的前提批判与经验分析

【摘要】：美国青少年司法改革运动历时百年,经历了不同的发展阶段,积累了丰富的经验。实践证明,设定独立青少年司法模式的前提不仅在理论上存在矛盾与不足之处,并且已经无法适应当今飞速变化的时代发展要求。美国百年青少年独立司法模式的实践经验同样证明了这一具有开创性的司法模式在现实中的失败。从美国独立青少年司法模式的前提批判入手,分析相关经验,可以为我国青少年司法模式的改革与完善提供参考与借鉴。
[Abstract]:The juvenile justice reform movement in the United States lasted for 100 years, experienced different stages of development and accumulated rich experience. Practice has proved that the premise of setting the independent juvenile justice model is not only contradictory and inadequate in theory, but also unable to meet the requirements of the rapidly changing times. A hundred years' experience in the practice of independent juvenile justice in the United States also proves the failure of this pioneering judicial model in reality. Starting from the premise critique of the American independent juvenile justice model and analyzing the relevant experience, it can provide reference and reference for the reform and perfection of the juvenile justice model in our country.
