职务犯罪初查的现实困境与改革途径

【摘要】：职务犯罪初查在实践中发挥着重要作用,但由于初查的制度建设相对于初查实践活动严重滞后,职务犯罪初查面临着法律地位不明、初查功能不足、初查方式匮乏等现实困境。因此,为了充分发挥职务犯罪初查的功能和作用,有必要加快对初查制度的建设,明确初查的法律地位,设置合理有效的初查权,同时也要加强对初查工作的监督。
[Abstract]:The initial investigation of duty crime plays an important role in practice, but because of the serious lag in the system construction of the initial investigation compared with the practical activity of the initial investigation, the initial investigation of the duty crime is faced with such practical difficulties as the lack of legal status, the insufficiency of the function of the initial investigation and the lack of the way of the initial investigation. Therefore, in order to give full play to the function and function of the initial investigation of job-related crimes, it is necessary to speed up the construction of the system of initial investigation, clarify the legal status of the initial investigation, set up reasonable and effective power of initial investigation, and strengthen the supervision of the work of initial investigation.
