论法院文化

【摘要】：德沃金在《法律帝国》中有这样的表述:“在法律的帝国里,法院就是首都,法官就是法律帝国里的王侯,我们则是帝国的臣民,都是法律规则忠实的追随者与信徒。”法院作为担负特殊职能的国家审判机关,是社会正义的守护者,也是排解社会矛盾纠纷的最后一道防线。法官职业群体自身整体素质和形象,法院作出的裁决,对社会公众具有宣示作用,对公民法律意识的提高、法律素质的养成具有重要的促进作用。法院文化集中体现了法院人审理案件的指导思想和工作习惯,从某种意义上说,法院文化建设对法院工作、法治环境乃至整个社会建设起着根本性、基础性和长期性的推进作用。本文在对中外法院文化研究的理论现状和理论反思的基础上,通过对比“文明”与“文化”、先进与后进、“法院文化”与“法律文化”等概念,提出本文研究法院文化的基础——法院文化的概念:法院文化是以法官为中心的法院人群体在长期审判实践中形成的共同的价值观念和行为方式的总称,其具有政治性、人本性、职业性的特点。在概念确立以后,对法院文化的内涵进行了分析,指出法院文化应该由以法官为中心的全体法院人的价值观念、思维方式、司法理念、道德准则等群体同质精神的高度概括,法院文化主要表现在以法官为主体的法院人群体的行为方式上。研究法院文化的目的并不仅仅在于明确法院文化的概念、内涵和表现方式,其最重要的意义应该在于研究其辐射效应,也就是通过法院文化的建设和完善,对社会的建设和发展有着什么样的意义。笔者以法院文化对法治建设影响这一视角,通过对中国法院文化和中国法治建设现状进行对比分析,推导出良好的法院文化对审判人员的行为举止意识具有积极的导向作用,进而影响我国司法机关的司法水平,最终影响到我国法治社会的建设,这一传导机制进一步肯定了法院文化对我国法治建设的重要作用。在法治建设的大环境中考察了法院文化以后,研究法院文化便有了更加全面的视角,对在中国当前条件下如何加强法院文化建设的设想也必将更加有针对性。因而,笔者对如何加强法院文化建设进行了进一步的研究,从作为法院文化物质表象的审判大楼、法庭、审判人员服饰等符号系统建设,到法律至上、遵守规则、保持中立、合理创新的法官职业伦理,再到法官行为方式的引导,对如何加强法院文化建设进行了初步探索。法院文化作为客观存在一直都在影响着法院人的行为模式,影响着中国的法治建设。如果能够形成以“公正、廉洁、为民”为核心的中国法院文化,并将其扩大到影响整个法治环境上、扩大到影响人们日常生活的行为方式上,这将对中国社会的起着不可估量的作用。目前,我国法院文化建设还处于起步阶段,各种相应的研究较少,法院文化影响法治建设的途径还不够明晰。因此,在法院文化的进一步研究中,要从以提高法院人以及整个社会对法院文化的认同度,从而进一步扩大影响力为重点,将对法院文化的研究推向深入,必将有所收获。文章以此为基调,在最后部分,对今后法院文化的研究提出自己的希冀。
[Abstract]:In the empire of the law , the Court is the capital , the judge is the king of the legal empire , and we are the subjects of the law rule and the faithful followers of the legal rules . The court acts as the guarantor of social justice and the last line of defense of social contradictions . The court culture embodies the guiding ideology and the working habits of the court ' s judicial cases .

On the basis of the present situation and theoretical reflection of the study of Chinese and foreign court culture , this paper puts forward the concept of " civilization " and " culture " , advanced and backward , " court culture " and " legal culture " .

The purpose of studying the court culture is not only to clarify the concept , connotation and expression of the court culture , but also to study its radiation effect , which is the construction and perfection of the court culture , the construction and development of the society .

After investigating the court culture in the large environment of the construction of the rule of law , the study of the court culture has a more comprehensive view , and it will be more focused on how to strengthen the court culture construction under the current conditions of China .

As an objective existence , the court culture has been affecting the behavior pattern of the court , affecting the construction of the rule of law in China .
