看守所问题在我国司法改革中的发展

【摘要】：看守所的问题在我国司法改革过程中已经成为了中心的问题,作为我国司法改革中的重点内容,我们相关公安部门应该尽全力完善看守所问题中的种种弊端,完善看守所问题中的制度、体制以及基础设施,彻底改变我国现阶段看守所问题中的种种症结。看守所的历史发展过程是单向度的,过多地强调了对在押人员的看管、改造甚至是深挖犯罪、配合惩治犯罪,而人权保障的功能并未得到彰显,这与我国法制建设的历史进程发展全局是紧密相关的。在当时的历史条件下,看守所的功能定位、管理体制以及具体的制度很难具备现代法治的要素。通过本文的研究我们可以更加认清在我国现阶段司法改革中看守所问题的发展以及演变,可以更加深刻地认识到看守所现阶段所存在的问题的严重性,针对甘肃省司法改革中看守所问题的演变分析实例,我们可以探索到解决问题的办法,并以此为例进一步分析现阶段我国看守所存在的相关问题。这对未来我国看守所问题的发展具有高度的借鉴意义,对我国今后的司法改革同样具有参考价值,对现阶段看守所问题的探究也具有高度的理论意义。本文研究的创新的地方主要为：以我国看守所的发展为研究切入点,深度地剖析了我国看守所问题在司法改革过程中所存在的种种问题,并以甘肃省的发展为分析实例进而更为有力地证明了这一论点。
[Abstract]:The issue of detention centers has become a central issue in the course of judicial reform in our country. As the key content of judicial reform in our country, our relevant public security departments should do their utmost to improve the problems of detention centers. To perfect the system, system and infrastructure of the detention center, and to completely change the crux of the detention center problem at present in our country. The historical development process of the detention center is unidirectional. Too much emphasis has been placed on the custody of the detainees, reform and even deep digging of crimes, and cooperation in punishing crimes, but the function of human rights protection has not been demonstrated. This is closely related to the overall development of China's legal system. Under the historical conditions at that time, it is difficult to have the elements of modern rule of law in the functional orientation, management system and concrete system of the detention center. Through the research of this paper, we can recognize the development and evolution of the detention center problem in the current judicial reform of our country, and can deeply realize the seriousness of the problems existing in the detention center at the present stage. Based on the analysis of the evolution of detention centers in judicial reform in Gansu Province, we can explore the solutions to the problems, and take this as an example to further analyze the problems existing in detention centers in our country at this stage. This is of great significance to the future development of detention centers in our country, as well as to the judicial reform in the future. It is also of great theoretical significance to the study of detention centers at the present stage. The innovations of this paper are as follows: taking the development of detention centers in our country as the starting point of research, this paper analyzes in depth the problems existing in the judicial reform of detention centers in our country. Taking the development of Gansu Province as an example, this thesis is proved more forcefully.
