论我国法院书记员制度的改革与完善

【摘要】:根据“十二五”规划发展战略,提出我国要建设社会主义法治国家。依法治国的战略方针不仅要求司法机关要秉公执法、维护司法公正,而且还要求有完善的司法体制得以保障。书记员作为法官工作中不可或缺的司法辅助人员,协助法官组织庭审、办理案件、制作文书和送达判决等一系列活动,是法院体系中重要的组成人员,对于他们的改革也备受关注。建立完善的书记员管理体制,打造一支高技能、高素质的司法团队是顺应司法改革发展的必然要求。本文主要通过分析2003年10月由中组部、人事部和最高人民法院联合颁发《人民法院书记员管理办法(试行)》(以下简称《管理办法》)在实施过程中出现的一系列问题,结合对域外一些司法比较发达的国家如美国、英国和日本的司法制度考察,提出了适合我国改革的构想。构想主要通过几个不同侧面的制度建设来完善我国现有的书记员制度包括明确书记员的职责分工,规范书记员选任机制,,增强书记员业务培训,完善书记员考评模式,系统化书记员序列晋升管理制度,建立书记员问责机制。本文主要运用比较分析和归纳总结的研究方法,围绕书记员单独序列管理模式的建立,提出一些配套的人员选任、培训机制和晋升模式。书记员单独序列的实现,使得书记员能够在自己的序列中得到应有职位和级别的晋升,提高了书记员工作的能力和工作的积极性,改变现有的书记员制度发展的瓶颈状态。
[Abstract]:According to the development strategy of the twelfth five-year plan, this paper puts forward that our country should build a socialist country ruled by law. The strategic policy of governing the country according to law not only requires the judicial organs to enforce the law impartially and safeguard the judicial justice, but also requires a perfect judicial system to be guaranteed. As an indispensable judicial assistant in the work of judges, clerks assist judges in organizing court hearings, handling cases, making documents and serving judgments. They are important members of the court system. There is also concern about their reforms. It is necessary to establish a perfect management system of clerks and to build a high skill and high quality judicial team in accordance with the development of judicial reform. This paper mainly analyzes a series of problems that appeared in the process of implementation, which were issued jointly by the Central Organization Department, the Ministry of personnel and the Supreme people's Court in October 2003, in the course of the implementation of the regulations for Clerks of the people's Court (trial) > (hereinafter referred to as "the Administration measures"). Based on the investigation of the judicial systems of some foreign countries, such as the United States, Britain and Japan, this paper puts forward some ideas suitable for the reform of our country. The conception mainly through several different aspects of system construction to improve the existing system of clerks in our country, including clarifying the division of duties of clerks, standardizing the mechanism of selecting and appointing clerks, enhancing the training of clerks, and perfecting the evaluation mode of clerks. Systematize the management system of clerk sequence promotion and establish the clerk accountability mechanism. This article mainly uses the comparative analysis and the induction summary research method, revolves around the clerk individual sequence management pattern establishment, proposed some matching personnel selection, the training mechanism and the promotion pattern. The realization of the separate sequence of clerks enables the clerks to get the promotion of posts and levels in their own sequence, improves the ability and enthusiasm of the clerks, and changes the bottleneck state of the development of the clerical system.
