行政违法行为检察监督制度研究

【摘要】:作为经由宪法赋予专门的法律监督职能的检察机关,理所应当有权力也有相应的义务对行政机关的行政违法行为进行检察监督,但长期以来,由于只有宪法授权而没有具体的法律授权,再加上检察院内部重刑而轻民行的观念,刑强而民行弱的部门格局,造成检察院对行政违法行为的检察监督职能处于尴尬的若有若无境地,以往的行政违法行为的检察监督也处于理论的状态,随着党的十八届四中全会以文件的形式确认检察机关对行政违法行为的检察监督,各地开展各项对行政行为的检察监督,包括对行政执法行为的检察监督、检察机关提起行政公益诉讼,取得了不少成绩。但由于处于摸索阶段,本文借鉴国外相关制度的发展经验,对于实践中出现的一些问题,从行政违法行为检察监督的本身概念出发,对于违法行为的边界、范围、程度进行探讨,对于一些存在的问题进行分析,提出自己的意见,对于从违法行为的概念、违法行为的范围、违法行为的程度等进行概念分析,同时对启动程序,相关制度之间的边界进行相关研究,同时提出自己对完善检察监督制度的一些建议,从应遵循的原则、对于检察建议的完善,对于程序的规范运行提出自己的建议。全文分四个部分进行论述:第一部分对行政违法行为检察监督制度的一些基本理论问题进行了讨论。第二部分对域外行政违法行为检察监督制度进行分析跟总结。第三部分对我国行政违法行为检察监督制度存在的问题及原因进行分析。第四部分提出了对行政违法行为检察监督制度完善的具体方案。
[Abstract]:As a procuratorial organ endowed with special legal supervision function by the Constitution, it is natural that it has the power and the corresponding obligation to supervise the administrative illegal acts of the administrative organs. But for a long time, Because only the constitutional authorization and no specific legal authorization, coupled with the concept that the procuratorate's internal punishment is heavy but not the people's conduct, the pattern of departments where the punishment is strong but the people are weak, If the procuratorial supervision function of procuratorates on administrative illegal acts is in an awkward situation, if there is no situation, the procuratorial supervision of administrative illegal acts in the past is also in a theoretical state. As the fourth Plenary session of the 18th CPC Central Committee confirmed the procuratorial supervision of administrative illegal acts by procuratorial organs in the form of documents, all localities carried out procuratorial supervision over administrative acts, including procuratorial supervision of administrative law-enforcement acts. Procuratorial Orgnaization institute administrative public interest lawsuit, obtained a lot of achievement. However, due to being in the groping stage, this paper draws lessons from the development experience of foreign related systems, for some problems in practice, starting from the concept of procuratorial supervision of administrative illegal acts, for the boundary of illegal acts, the scope, The degree of discussion, analysis of some existing problems, put forward their own opinions, from the concept of illegal acts, the scope of illegal acts, the extent of illegal activities, and so on, at the same time to start the process, At the same time, the author puts forward some suggestions on how to perfect the procuratorial supervision system, from the principles to be followed, to the perfection of the procuratorial suggestions, and to the standardized operation of the procedure. The paper is divided into four parts: the first part discusses some basic theoretical problems of procuratorial supervision system of administrative illegal acts. The second part analyzes and summarizes the procuratorial supervision system of the extraterritorial administrative illegal acts. The third part analyzes the problems and causes of the procuratorial supervision system of administrative illegal acts in China. The fourth part puts forward the concrete scheme of perfecting the procuratorial supervision system of administrative illegal acts.
