往返流盼:检察机关一般监督权的考证与展望

【摘要】：受革命道路、政体结构、法制传统、诉讼资源等因素影响,检察机关一般监督权在法律发展史中命运跌宕,经历了数百年的枯荣和沉浮。从俄国彼得大帝的初步实践,到苏联的系统运行,强调最高性、全面性、单向性的一般监督权在维护法制统一上有得有失、毁誉参半。当前,包括俄罗斯在内的两大法系主要国家,仍然存续着有限的一般监督权,并在监督方式上呈现出针对性、有效性、双向性的发展趋势。基于法制统一、保障人权等目标,我国可在合宪性监督、劳动教养监督、检察建议权、行政执法监督上明确有限的一般监督权。
[Abstract]:Influenced by revolutionary road, political system structure, legal system tradition, litigation resources and other factors, the procuratorial organ's general supervisory power has experienced the ups and downs for hundreds of years in the history of legal development. From the preliminary practice of Russian Peter the Great to the systematic operation of the Soviet Union, the general supervisory power of supremacy, comprehensiveness, and unidirectionality had gains and losses in maintaining the unity of the legal system, with mixed reputation. At present, the main countries of the two major legal systems, including Russia, still have limited general supervision power, and present the development trend of pertinence, effectiveness and bidirectional in the way of supervision. Based on the goal of the unification of legal system and the protection of human rights, our country can make clear the limited general supervision power on the supervision of constitutionality, the supervision of re-education through labor, the right of procuratorial suggestion and the supervision of administrative law enforcement.
