法院主持下的调解机制比较研究

【摘要】：调解是中国传统社会定纷止争的重要方式。法院主持下的调解作为我国调解制度的重要组成部分,是法院对民事案件行使审判权和当事人对自己的民事诉讼权利和民事权利行使处分权的结合,在解决当事人纠纷方面发挥了积极的作用,也对中国法治发展进程作出了独特的贡献。当前,随着改革开放的进一步深入,我国社会形态呈现多样化,社会矛盾呈现多样性、复杂性和多发性,民事、经济等纠纷案件逐年上升,法院维护社会稳定的任务日益繁重,法院主持下的调解工作面临新问题新挑战。在比较研究的基础上,重新审视和解读法院主持下的各种调解机制对理解我国倡导的“大调解”理念、推动司法改革进程、加快国家法治建设具有积极的意义。本文试从司法运行现状入手,明确法院主持下的各种调解机制的立法框架、种类、特征及成因;分析法院主持下的各种调解机制之间的共同点和差异点,阐明相互间的衔接与协同;分析我国当前国情下法院主持下的各种调解机制存在必要性和一定程度上的合理性;分析比较国内外相关制度,以比较法的视野研究我国法院主持下的各种调解机制;最后提出一些完善法院主持下的各种调解机制的思路和设想,通过树立正确的调解理念、明确定位法院主持下的调解机制和创新法院主持下的调解艺术,以期尽快完善与推进法院主持下的各种调解机制,以适应多层次的司法需求、多元化的程序设计和多种类的审判运作。
[Abstract]:Mediation is an important way to settle disputes in traditional Chinese society. Mediation under the auspices of the court, as an important part of the mediation system in our country, is the combination of the exercise of judicial power in civil cases by the court and the right of the parties to exercise their own civil litigation rights and the right to dispose of civil rights. It has played an active role in resolving disputes between parties and has made a unique contribution to the development of China's rule of law. At present, with the further deepening of reform and opening up, the social forms of our country present diversification, social contradictions present diversity, complexity and multiple, civil, economic and other disputes cases rise year by year, the task of the courts to maintain social stability is increasingly heavy. Mediation under the auspices of the Court faces new problems and challenges. On the basis of comparative study, it is of positive significance to re-examine and interpret various mediation mechanisms under the auspices of the Court to understand the concept of "Great Mediation" advocated by our country, to promote the process of judicial reform and to speed up the construction of the country's rule of law. Starting with the current situation of judicial operation, this paper clarifies the legislative framework, types, characteristics and causes of various mediation mechanisms under the auspices of the court, and analyzes the common points and differences between the various mediation mechanisms under the auspices of the court. To clarify the cohesion and synergy between each other; to analyze the necessity and rationality of various mediation mechanisms under the auspices of the court under the current situation of our country; to analyze and compare the relevant systems at home and abroad, From the perspective of comparative law, this paper studies various mediation mechanisms under the auspices of Chinese courts, and finally puts forward some ideas and ideas for perfecting the mediation mechanisms under the auspices of the courts, and sets up a correct mediation concept. Clearly positioning the mediation mechanism under the auspices of the court and innovating the mediation art under the auspices of the court, in order to improve and promote the mediation mechanism under the auspices of the court as soon as possible, in order to meet the multi-level judicial needs, Diversified programming and a variety of trial operations.
