司法改革的实验方法——以试点方案的类型化设计为研究对象

【摘要】：无论就其深度还是广度而言,业已启动的司法体制机制改革充分体现了决策层推进国家治理体系现代化的愿望与决心。而要确保改革的预期效果得以达成,仅有世界观意义上的缜密设计是不够的,还需方法论层面上的科学指引。试点方法的大规模运用,无疑使当下的司法改革具有了浓郁的实验色彩。而熟练掌握试点实验方法,借助设计方案的周延性,充分评估改革举措的实际效应,将有助于树立其推广价值。通过对域外经验的借鉴,结合诸项现实环境因素的考察,可以为法治中国的推进寻求切实可行的司法路径。
[Abstract]:In terms of its depth and breadth, the reform of judicial system has fully reflected the desire and determination of the decision-makers to promote the modernization of the national governance system. In order to ensure that the expected effect of reform can be achieved, it is not enough to design meticulously in the sense of world view, but also need the scientific guidance of methodology. The large-scale application of the pilot method undoubtedly makes the current judicial reform have a strong experimental color. Mastering the experimental method skillfully and evaluating the actual effect of the reform fully with the help of the periodicity of the design plan will help to set up its popularizing value. Through the reference of the overseas experience and the investigation of various realistic environmental factors, we can find a feasible judicial path for the advancement of China ruled by law.
