民事检察监督权存废论

【摘要】：在民事诉讼领域回归当事人主义模式的背景下,民事检察监督制度屡遭诟病。本文将采用法哲学、法社会学等实证研究方法分析当事人主义在民事诉讼尤其是再审程序中的现实意义,以对中外民事诉讼检察监督制度发展轨迹的纵向研究和当今世界各国该项制度的横向比较为基础,发掘并阐释东西方诉讼文化和各个法系中对于检察监督制度内涵的不同理解,运用大量案例资料和数据,从民事检察监督制度的理论基础、运行规律、监督效果和发展趋势加以剖析,论证该项制度与民事诉讼基本理论之间的不可调和的矛盾冲突,支持废除民事检察监督权的合理性、正当性和可行性,同时大胆设想了废除民事检察监督制度后的检察监督权归属。
[Abstract]:Under the background of returning to the mode of litigant doctrine in the field of civil litigation, the system of civil procuratorial supervision is frequently criticized. This article will use the legal philosophy, the law sociology and so on empirical research method to analyze the litigant doctrine in the civil lawsuit, especially in the retrial procedure realistic significance, Based on the longitudinal study of the development track of the procuratorial supervision system in China and foreign countries and the horizontal comparison of this system in various countries in the world, this paper explores and explains the different understandings of the connotation of the procuratorial supervision system in the Eastern and Western litigation cultures and in various legal systems. By using a large number of case materials and data, this paper analyzes the theoretical basis, operation law, supervision effect and development trend of the civil procuratorial supervision system, and demonstrates the irreconcilable conflict between the system and the basic theory of civil procedure. This paper supports the rationality, legitimacy and feasibility of abolishing the civil procuratorial supervisory power, and conceive the ownership of the procuratorial supervision power after abolishing the civil procuratorial supervision system.
