湖南省法院解决“执行难”情况的调查

【摘要】：“执行难”一直是困扰法院工作的难点问题，也是人民群众普遍关心的热点问题。如果“执行难”问题解决不了，不仅严重影响人民法院的司法权威，而且损害人民群众的合法权益。目前学术界和实务界都在大力探求解决“执行难”的途径和方法，取得了许多宝贵经验。通过对湖南全省法院近两年来在执行工作中的创新方法、实际效果以及出现的问题进行调查研究，以期能够找到进一步破解“执行难”问题的新思路、新办法。湖南法院在解决“执行难”问题方面，形成了很多新的思路，探索了很多新的方法，都是值得提炼总结、并加以推广的。例如，全省法院围绕“社会矛盾化解、社会管理创新、公正廉洁执法”三项重点工作，进一步加大了执行创新力度，推动执行工作科学发展。一是反规避执行专项活动深入推进。二是执行信息平台建设开始启动。三是执行监督管理体系进一步完善。形成以省法院为龙头，各中级法院为枢纽，各基层法院为基础的案件督办管理体系。四是自觉接受监督措施不断强化。正是这些创新举措，全面提升了湖南法院的执行工作质效。通过对湖南法院执行工作调查资料的深入分析，法院执行部门要破解“执行难”，提高执行案件的效率和质量，必须加强以下几个方面的工作：一是要构筑党委统筹的执行格局；二是要建立统一管理的执行体制，包括加执行领导、升格执行机构、严格执行制度；三是推行分权制衡的执行机制，包括科学分权执行、分段集约执行、立审协调执行；四是要探索刚柔并济的执行方法，包括强化威慑执行措施、推行和解执行方式。
[Abstract]:The difficulty of execution has always been a difficult problem in the work of the court, and it is also a hot issue of general concern to the people. If the problem of "difficult execution" cannot be solved, it will not only seriously affect the judicial authority of the people's court, but also damage the legitimate rights and interests of the people. At present, the academic and practical circles are exploring the ways and methods to solve the difficulty of execution, and have gained many valuable experiences. Through the investigation and study of the innovative methods, practical effects and problems in the execution of the courts in Hunan Province in the past two years, the author hopes to find new ideas and new methods for further solving the problems of "difficult execution". Hunan court has formed many new ideas and explored many new methods in solving the problem of "difficult execution", which is worth refining and summing up and popularizing. For example, the provincial courts focus on the three key tasks of "resolving social contradictions, innovating social management, and enforcing the law impartially and incorruptibly", which has further increased the strength of execution innovation and promoted the scientific development of enforcement work. First, anti-circumvention implementation of special activities to promote in-depth. Second, the implementation of information platform construction began to start. Third, the implementation of supervision and management system to further improve. A case supervision and management system based on provincial courts, intermediate courts and grass-roots courts is formed. Fourth, self-conscious acceptance of supervision measures continue to strengthen. It is these innovative measures that improve the quality and effectiveness of the Hunan Court's enforcement work in an all-round way. Through the in-depth analysis of the investigation data of the execution work of the Hunan Court, the executive department of the court should solve the "difficulty of execution" and improve the efficiency and quality of the execution case. We must strengthen the work in the following aspects: first, to construct the overall implementation pattern of the Party committee; second, to establish an executive system of unified management, including the addition of executive leadership, upgrading the executive organ, and strictly enforcing the system; The third is to carry out the executive mechanism of separation of powers and checks and balances, including the implementation of scientific decentralization, piecewise and intensive execution, and coordinated execution; fourth, it is necessary to explore the implementation methods of the combination of rigidity and flexibility, including strengthening the measures of deterrence implementation and implementing the way of reconciliation.
