实习律师事务所教学模式探析

【摘要】：法律职业是一种对经验、技术、专业要求很高的职业,因此它需要法学教育能培育出具备经验技术的专业化法律人才,在这里法学教育模式的选择就显得尤为重要。 我国对法学教育模式的探索一直都是在不断地摸索中前进,像2000年在美固福特基金会的资助下,我们引进了诊所式法律教育,它确实为我国法学教育事业的发展带来了新鲜的气息,但是由于师资、资金等方面的原因,它在中国出现了很多问题。因此,我们有必要走中国化的法学教育道路,实施有特色的法学教育培养模式,这对于解决法学教育与法律职业长期处于分离状态的问题有很大的益处。 法学与医学有很多相似的地方,医学院设立许多附属医院,那么我们能不能试着设立像附属医院那样的实习律师事务所?让更多的法学学生在那里实习,增加自己的实践能力,这是一个可以探讨的问题。
[Abstract]:The legal profession is one kind of profession which requires highly the experience, the technology, the specialized profession, therefore it needs the law education to cultivate the specialized legal talents with the experience technology, the choice of the legal education mode is particularly important here. The exploration of the legal education model in our country has always been moving forward in the process of continuous exploration. For example, in 2000, with the aid of the Meigu Ford Foundation, we introduced clinical legal education. It does bring fresh breath to the development of legal education in China, but because of the reasons of teachers, funds and so on, it has many problems in China. Therefore, it is necessary for us to follow the Chinese way of legal education and implement the characteristic mode of legal education, which is of great benefit to solving the problem of the separation of law education and legal profession for a long time. There are many similarities between law and medicine, medical schools have many affiliated hospitals, so can we try to set up an internship law firm like a affiliated hospital? Let more law students practice there, increase their practical ability, this is a question that can be explored.
