MF房产集团法务管理优化研究

【摘要】：企业作为营利性组织,随着经济全球一体化趋势的进一步加强,开放性的国际市场环境既为企业的发展带来了众多机遇,同时也使企业在发展壮大过程中面临着多重的风险。市场的开放性,在为企业的发展提供越来越多交往平台和盈利机遇的同时,也在考验着企业应对风险、处理问题的能力。特别是相对于今天的中国社会而言,风险应对,对企业的发展有着十分重要的现实意义。从计划经济体制到社会主义市场经济体制,中国社会正在经历经济体制根本性变革的重要转型期。在体制转型的同时,整个社会的产业结构也处于持续调整与不断完善的过程中,并且从未来的发展趋势看,深化经济体制改革,重视产业结构调整更是一种必然。在这种复杂的环境下,企业的发展受到外部环境影响的可能性越来越大,企业需要承担和处理的各种法律风险越来越多。在这种客观现实下,传统的企业法务管理模式已经无法适应现代企业制度建立的需要。为了提升企业的防风险能力和应对各种风险的水平,我们应当在企业内部积极的构建新型的法务管理制度。 本文的主要内容就是通过中外企业法务管理制度的分析介绍,分析当前我国企业法务管理的现状,并且以MF房产集团为代表,探析中国企业在法务管理工作上存在的漏洞以及缺陷。分析推行现代法务管理工作的可行性和必要性,为实现企业法务管理工作的优化改进提出意见和建议。
[Abstract]:As a profit-making organization, with the further strengthening of the trend of global economic integration, the open international market environment not only brings many opportunities for the development of enterprises, but also makes enterprises face many risks in the process of development and expansion. The openness of the market not only provides more and more communication platform and profit opportunities for the development of enterprises, but also tests the ability of enterprises to deal with risks and problems. Especially compared with today's Chinese society, risk management has a very important practical significance for the development of enterprises. From planned economy system to socialist market economy system, Chinese society is undergoing an important transition period of fundamental transformation of economic system. At the same time of system transformation, the industrial structure of the whole society is also in the process of continuous adjustment and continuous improvement, and from the perspective of the future development trend, it is inevitable to deepen the economic system reform and attach importance to the adjustment of industrial structure. In this complex environment, the development of enterprises is more and more likely to be affected by the external environment, enterprises need to bear and deal with a variety of legal risks more and more. In this kind of objective reality, the traditional corporate forensic management mode has been unable to meet the needs of the establishment of modern enterprise system. In order to improve the ability of risk prevention and the level of dealing with various risks, we should actively build a new legal management system within the enterprise. The main content of this paper is to analyze the current situation of legal affairs management in Chinese and foreign enterprises through the analysis and introduction of the legal affairs management system of Chinese and foreign enterprises, and take MF real estate group as the representative. This paper probes into the loopholes and defects in the legal affairs management of Chinese enterprises. This paper analyzes the feasibility and necessity of carrying out the modern legal affairs management, and puts forward some suggestions and suggestions for realizing the optimization and improvement of the legal affairs management in enterprises.
