《伯尔尼联盟总协定》制度框架下的中国出口信用保险制度

【摘要】：规范国际出口信用保险人的《伯尔尼联盟总协定》,是发达国家协商的结果。该《协定》总结了出口信用保险的国际先进性经验,虽属于软法,但是其强制性规定仍具有约束力。中国出口信用保险有限公司属于政策性保险公司,其官办、垄断与立法空白的现状,导致中国出口信用保险业务的监管处于无法可依的状态。这既不利于实现中国出口与海外投资的政策目标,也不利于防范国有资产流失。文章阐述了中国出口信用保险制度存在公司治理结构违法、国家指令性承保任务背离了保险的基本原理、承保信息不透明、保单条款存在诸多霸王条款等问题,并结合《伯尔尼联盟总协定》的制度框架与发达国家经验,提出了完善中国出口信用保险法律制度的对策。
[Abstract]:The General Agreement of the Berne Union, which regulates international export credit insurers, is the result of negotiation in developed countries. The Agreement summarizes the international advanced experience of export credit insurance, although it belongs to soft law. However, its mandatory provisions are still binding. China Export Credit Insurance Co., Ltd. is a policy insurance company, its official, monopoly and legislative blank status quo. The supervision of China's export credit insurance business is in a state of impossibility, which is not conducive to the realization of China's export and overseas investment policy objectives. It is not conducive to the prevention of the loss of state-owned assets. This paper expounds the existence of illegal corporate governance structure in China's export credit insurance system. The state directive underwriting tasks deviate from the basic principles of insurance and the underwriting information is opaque. There are many problems in policy terms, such as overlord clauses. Combined with the institutional framework of Bern Union General Agreement and the experience of developed countries, the author puts forward some countermeasures to perfect the legal system of China's export credit insurance.
