国际组织现行网络域名争议解决问题研究

【摘要】：网络域名在现代社会具有较高的经济价值。本文着重比较分析现阶段ICANN在全球范围内授权的四个网络域名争议解决服务提供者在现阶段适用《统一域名争议解决政策》(“《政策》”或“UDRP”)中的异同。UDRP实行十年多来在网络域名争议领域形成了大量的国际案例。通过对世界知识产权组织的国际案例进行分析概括这一独特视角,本文旨在明确现阶段国际实践中在域名争议领域达成的共识及存在的分歧。本文还通过现阶段网络域名争议解决的国际机制与国内机制的比较分析得出结论,前者让位于后者,且前者并非争议解决的必经之路,二者并无主次之分。本文提出了国际网络域名争议解决领域新出现的问题,并提出笔者对于我国面对这些新问题的几点建议。
[Abstract]:Internet domain name has high economic value in modern society. This paper focuses on the comparison and analysis of the four web domain name dispute resolution service providers authorized by ICANN in the world at this stage. Dispute Resolution Policy. (. "Policy" or "UDRP"). UDRP has formed a large number of international cases in the domain of domain name disputes over the past ten years. This unique perspective is summarized through the analysis of the international cases of the World intellectual property Organization (WIPO). The purpose of this paper is to clarify the current international practice in the domain of domain name disputes reached consensus and differences, this paper also through the current Internet domain name dispute resolution of the international mechanism and domestic mechanisms of comparative analysis to draw a conclusion. The former gives way to the latter, and the former is not the only way to resolve disputes, there is no difference between the two. This paper puts forward the new problems in the field of international domain name dispute resolution. At the same time, the author puts forward some suggestions for our country to face these new problems.
