陆地边界与海洋边界差异性比较研究

【摘要】：边界是国际关系中一个极其重要的主题,边界争端是邻国间普遍存在的现象,也是影响国家间关系的重要因素之一。按照边界穿越的自然空间的不同,可将其分为陆地边界、海洋边界和空中边界。其中,陆地边界和海洋边界是研究最多的两种边界形式。陆地边界是基础,一般经过定界、划界、勘界三个阶段予以确定,边界只有按照条约确定之后才拥有法律地位。1982年《联合国海洋法公约》的制定较为详实地提出了海洋划界原则和争端解决方式,为进一步解决海洋边界争端提供了法律依据。陆地边界和海洋边界虽有相似之处,但二者仍存在很大差别。二者从自然特征、功能、划界原则再到产生争端的原因、争端解决方式都存在差异。这些差异使得对待海洋边界和陆地边界不能采取同样的态度和方式,在解决海陆边界争端也应当具体问题具体分析。陆地边界问题的解决方式不一定可以适用于海洋边界,海洋边界争端的解决面临更多的困难,这也是目前众多海洋边界争端没有得到妥善解决的重要原因之一。明确陆地边界和海洋边界的区别对于解决海陆边界争端有重要的理论意义。尤其对同时面临海陆边界争端问题的中国而言,亟需重视对陆地与海洋边界的相关研究。中国需要清楚地认识到,新中国成立初期和平解决边界争端的方式已经不再适用于当前的边界争端,因此中国必须在重视陆地边界和海洋边界差异的基础上,根据不同的海陆边界争端制定出相应的解决方案。同时,加强对边界的管理,尤其是在海洋边界问题上,更应加强相关研究,为海洋开发及海洋利益维护提供指导,这对于维护我国的国家利益,进一步推进“一带一路”建设具有重要意义。
[Abstract]:Borders are an extremely important subject in international relations, and border disputes are a widespread phenomenon among neighbouring States and one of the important factors affecting relations between States. They may be divided into land boundaries according to the natural space in which borders cross, Maritime boundary and air boundary. Among them, land boundary and sea boundary are the two most studied boundary forms. The land boundary is the foundation, which is generally determined by three stages: demarcation, demarcation and demarcation. The boundary shall have legal status only after it has been established in accordance with the treaty. In 1982, the United Nations Convention on the Law of the Sea established the principle of maritime delimitation and the modalities for the settlement of disputes in a more detailed manner, It provides a legal basis for the further settlement of maritime boundary disputes. Although there are similarities between land boundaries and maritime boundaries, they are still very different. They range from natural characteristics, functions, delimitation principles to the causes of disputes. There are differences in the way in which disputes are settled. These differences make it impossible to adopt the same attitude and approach to maritime and land boundaries, The solution of land boundary problems may not necessarily be applicable to maritime boundaries, and the settlement of maritime boundary disputes faces more difficulties, This is also one of the important reasons why many maritime boundary disputes have not been properly resolved. It is of great theoretical significance to make clear the difference between land boundary and maritime boundary, especially to face the sea at the same time. In the case of China over the land border dispute, China needs to be well aware that the peaceful settlement of border disputes in the early days of the people's Republic of China no longer applies to current border disputes, Therefore, China must, on the basis of paying attention to the differences between land and sea boundaries, formulate corresponding solutions according to different maritime and land boundary disputes. At the same time, it must strengthen the management of its borders, especially with regard to maritime boundary issues. It is also necessary to strengthen relevant research and provide guidance for marine development and marine interest maintenance, which is of great significance for safeguarding the national interests of our country and further promoting the construction of "Belt and Road".
