国际海峡内分道通航制研究

【摘要】:《联合国海洋法公约》第三部分对用于国际航行的海峡相关制度进行了规定,其中第41条规定了海峡内的分道通航制。分道通航制在国际海峡内的建立极大提高了航行效率,在减少船舶碰撞事故、提高航行安全方面成果显著。目前,学术界对国际海峡内分道通航制的理论研究比较匮乏,为更有效地将分道通航制从理论运用到实践,本文基于《联合国海洋法公约》第41条的规定对国际海峡内的分道通航制问题展开研究,全文分为五个部分:第一部分是对相关制度的历史沿革的研究,包括国际海峡航行制度的历史发展以及《联合国海洋法公约》第41条的确立背景。历经曲折的发展过程后,用于国际航行的海峡的过境通行制度最终得以在《联合国海洋法公约》中确立。第二部分是对国际海峡内规定分道通航制的依据的研究,包括航行安全、航行条件以及主管国际组织的建议三类,主要分析了海峡沿岸国或国际海事组织在规定或替换分道通航制时应考虑的因素问题。第三部分是对国际海峡内规定分道通航制应遵守的除《联合国海洋法公约》以外的其他国际规章的研究,主要包括涉及到分道通航制的《国际海上避碰规则》、《国际海上人命安全公约》和《关于船舶定线制的一般规定》。海峡沿岸国规定的分道通航制及其所采取的行动应与包括这几类国际规章在内的国际法规定相一致。第四部分是对国际海峡内分道通航制涉及到的主体的权利与义务的研究,包括海峡沿岸国和船旗国的权利与义务。相关主体在规定或使用国际海峡内的分道通航制时,在享有国际法规定的权利的同时,应承担相应的责任与义务。第五部分是对中国在国际海峡分道通航制的理论与实践中所获得的启示的研究,主要包括中国有关分道通航制的立法与实践,以及对中国海上贸易往来至关重要的国际海峡内分道通航制的建立和中国船舶航行时应注意的问题,同时对在台湾海峡内建立分道通航制提出了设想。
[Abstract]:Part III of the United Nations Convention on the Law of the Sea provides for the relevant regimes of straits used for international navigation, article 41 of which provides for the system of traffic separation within straits, the establishment of which greatly improves the efficiency of navigation in international straits, There are remarkable achievements in reducing ship collision accidents and improving navigation safety. At present, the academic circles lack of theoretical research on the traffic separation system in international straits, in order to more effectively apply it from theory to practice. Based on the provisions of Article 41 of UNCLOS, this paper studies the traffic separation system in international straits. The thesis is divided into five parts: the first part is the study of the historical evolution of relevant systems. Including the historical development of the navigation regime in international straits and the background of the establishment of article 41 of the United Nations Convention on the Law of the Sea. The system of transit passage in straits used for international navigation was eventually established in the United Nations Convention on the Law of the Sea. The second part is a study of the basis for the provision of traffic separation in international straits, including the safety of navigation, Conditions of navigation and recommendations of competent international organizations, This paper mainly analyzes the factors that should be taken into account by the coastal States of straits or the International Maritime Organization in prescribing or replacing the traffic separation system. The third part is the exception of the United Nations Convention on the Law of the Sea which should be observed to regulate the traffic separation system in international straits. The study of other international regulations other than, Including the International Code for the Prevention of collisions at Sea, the International Convention for the Safety of Life at Sea and the General provisions on ship routing. Being consistent with the provisions of international law, including these categories of international regulations... 4th is a study of the rights and obligations of the subjects involved in the system of traffic separation in international straits, Including the rights and obligations of States bordering straits and flag States... while providing for or using the system of traffic separation in international straits, the relevant subjects, while enjoying their rights under international law, Part 5th is a study of the enlightenment gained by China in the theory and practice of the international channel traffic separation system, mainly including the legislation and practice of China's traffic separation system. The establishment of the international channel traffic system which is very important for China's maritime trade and the problems that should be paid attention to in the course of Chinese ships' navigation are also discussed. At the same time, some ideas are put forward for the establishment of the separation system in the Taiwan Strait.
