南大洋海洋保护区建设的最新发展与思考

【摘要】：历经5年谈判的罗斯海保护区提案终于在2016年10月南极海洋生物资源养护委员会第35届年会上获得通过。作为目前全球最大的海洋保护区,罗斯海保护区的建成是继南奥克尼群岛海洋保护区建成后,南大洋海洋保护区建设中的又一里程碑。从罗斯海保护区的实践出发,梳理总结南大洋海洋保护区建设中的主要法律争议,对南极海洋生物资源养护委员会建立管理海洋保护区的主体资格以及《南极海洋生物资源养护公约》中"养护"和"利用"两大目标的平衡进行了深入分析。展望今后在该海域设立其他海洋保护区的前景,并为中国的应对提出建议。
[Abstract]:After five years of negotiations, the Ross Sea protected area proposal was finally adopted at the 35th annual meeting of the Commission for the Conservation of Antarctic Marine living Resources, in October 2016, as the largest marine protected area in the world, The completion of the Ross Sea protected area is another milestone in the construction of the Southern Ocean Marine protected area following the completion of the South Orkney Islands Marine protected area. Combing and summing up the main legal disputes in the construction of the Southern Ocean Marine protected areas, The main qualifications of CCAMLR for the management of marine protected areas and the balance between "conservation" and "utilization" of the objectives of the Convention on the Conservation of Antarctic Marine living Resources are analyzed in depth. Looking forward to the prospects for the establishment of other marine protected areas in that area in the future, And put forward suggestions for China's response.
