【摘要】：气候变化影响着各国贸易的比较优势，从而进一步对国际贸易的模式和格局产生影响；国际贸易也通过贸易的规模效应、结构效应和技术效应影响着全球气候的变化。气候贸易的国际立法经历了漫长曲折的谈判和发展过程，形成了以《联合国气候变化框架公约》和《京都议定书》为基础的一系列国际文件；欧洲碳税制度、美国碳关税制度等他国的国内法也日趋完善。而我国现行气候贸易立法尚不完善，，相关规范性文件法律位阶较低且较为分散，对于发达国家针对我国提出的碳关税纠纷，缺乏完善有效的应对机制及熟悉相关国际法规则和外国法律的专业人才。加强气候贸易法律问题研究，尽快培养专业人才，已成我国法律及实务界的当务之急。论文第一部分首先就气候变化与国际贸易的关系进行了深入探讨，并对庇古理论、科斯定理等相关气候贸易的主要理论进行了阐述，在此基础上对气候贸易进行了明确地界定。论文第二部分全面考察分析了《联合国气候变化框架公约》、《京都议定书》、《巴厘路线图》、《哥本哈根协议》、《坎昆协议》等气候贸易的国际立法，深入探讨了其中涉及的重要理论与实践问题。论文第三部分深入分析了我国气候贸易现行立法与相关气候贸易措施方面的现状与不足，并指出，我国应完善气候贸易的相关国内立法和现行气候贸易机制，建立健全气候贸易的法律制度体系。同时积极参加气候贸易的国际规则制定，培养具有相关专业知识及资质的从业人员和机构。论文第四部分针对我国气候贸易现行立法与措施的现状，从立法体系的完善、清洁发展机制、排放权交易机制、碳关税应对、抵消与奖励机制等方面提出构建与完善我国气候贸易法律制度的系统建议。
[Abstract]:Climate change affects the comparative advantage of each country's trade, which further influences the mode and pattern of international trade. International trade also influences the global climate change through the scale effect of trade, structural effect and technological effect. International legislation on climate trade has undergone a long and tortuous process of negotiation and development, resulting in a series of international documents based on the United Nations Framework Convention on Climate change and the Kyoto Protocol. The domestic laws of other countries, such as the United States carbon tariff system, are also becoming more and more perfect. However, the current climate trade legislation in China is still imperfect, the legal rank of relevant normative documents is low and scattered, and for the carbon tariff disputes proposed by developed countries against China, The lack of perfect and effective coping mechanism and professional personnel familiar with relevant rules of international law and foreign law. Strengthening the research on the legal issues of climate trade and training professional personnel as soon as possible has become an urgent task in the legal and practical circles of our country. In the first part of the paper, the relationship between climate change and international trade is discussed, and the main theories of climate trade, such as Pigou theory, Coase theorem and so on, are expounded. On this basis, the climate trade is clearly defined. In the second part of the thesis, the international legislation on climate trade, such as the United Nations Framework Convention on Climate change, the Kyoto Protocol, the Bali Road Map, the Copenhagen Accord, the Cancun Agreement, etc. The important theoretical and practical problems involved are discussed in depth. The third part of the paper analyzes the current situation and deficiency of the current legislation on climate trade and related climate trade measures in China, and points out that China should perfect the relevant domestic legislation and current climate trading mechanism of climate trade. To establish and improve the legal system of climate trade, to take an active part in the international regulation making of climate trade, and to train practitioners and institutions with relevant professional knowledge and qualifications. The 4th part of the thesis aims at the current situation of legislation and measures on climate trade in China, from the perfection of the legislative system, the clean development mechanism, the emission trading mechanism, the carbon tariff response, Some systematic suggestions on how to construct and perfect the legal system of climate trade in China are put forward in the aspects of countervailing and reward mechanism.
