【摘要】：本文围绕着双边投资条约之安全例外条款这一中心,具体探讨了双边投资条约中的安全例外条款、ICSID仲裁实践中对于安全例外条款的解释及在缔约实践中我国的双边投资条约在安全例外条款上存在的问题。本文包含三个部分,分别是前言、正文及结束语。正文分为四章：第一章为安全例外条款的基本概述。本章分为三个部分,第一部分为安全例外条款若干基本概念的界定。这部分首先对于安全例外条款的概念做了界定,接着对本文所研究的双边投资条约的范围做了说明。第二部分为安全例外条款的起源和晚近发展,该部分首先介绍了安全例外条款的起源,然后探讨了近年来安全例外条款在双边投资条约中的进一步发展。第三部分介绍了安全例外条款的功能。第二章主要研究了国际投资条约约文中的安全例外条款。本章分为两个部分,第一部分研究了不同条约约文中安全例外条款的措辞,并进一步分析采用不同措辞的优缺点。第二部分探讨了安全例外条款的文本解释和目的解释两种解释方法。第三章集中于对国际投资仲裁实践中的安全例外条款进行分析。本章共分为四个部分,第一、二部分是对关键性概念的定义和解释,本部分将结合国际投资仲裁实践对于安全例外条款的“基本安全利益”和“所必需”进行解释。第三部分探讨了安全例外条款与习惯国际法中危急情势的关系。第四部分是对于成功援用安全例外条款结果的思考,本部分将对适用安全例外条款是否可以免除国家的赔偿责任进行讨论。第四章为我国的缔约现状、不足与对策。本章分为两部分,第一部分对于我国缔结的双边投资条约之安全例外条款的现状和不足进行了分析,认为我国在目前的缔约中存在四点不足。第二部分基于资本输入和输出国的两种视角对我国缔结的双边投资条约之安全例外条款的完善提出了若干建议。
[Abstract]:This paper revolves around the security exception clause of bits, This paper probes into the interpretation of the security exception clause in ICSID arbitration practice and the problems existing in the security exception clause in the bilateral investment treaty of our country in the practice of contracting. This paper consists of three parts: preface, text and conclusion. The text is divided into four chapters:. This chapter is divided into three parts. The first part is the definition of some basic concepts of security exception clause. The second part is the origin and recent development of the security exception clause. This part first introduces the origin of the security exception clause. Then it discusses the further development of security exception clauses in bilateral investment treaties in recent years. The third part introduces the function of security exception clauses. This chapter is divided into two parts. The first part studies the wording of the security exception clause in different treaties. Furthermore, the advantages and disadvantages of using different terms are analyzed. The second part discusses two interpretation methods: the text interpretation and the purpose interpretation of the security exception clause. The third chapter focuses on the analysis of the security exception clause in the practice of international investment arbitration. This chapter is divided into four parts. The first and second parts are the definition and interpretation of the key concepts. This part will explain the "basic security interests" and "necessary" of the security exception clause in the light of the practice of international investment arbitration. The third part discusses the relationship between the security exception clause and the necessity situation in customary international law. The 4th part is a reflection on the results of the successful application of the security exception. This section will discuss whether the application of the security exception can exempt the State from liability. This chapter is divided into two parts. The first part analyzes the current situation and deficiency of the security exception clause of the bilateral investment treaty concluded by our country. The second part puts forward some suggestions on the perfection of the security exception clause of bilateral investment treaties concluded by China based on the two perspectives of capital input and exporting countries.
