【摘要】：本文旨在研究TRIPS时代网络版权保护技术措施,正文分四章展开论述。第一章探讨了网络版权保护的利益平衡。这种利益平衡体现在网络版权保护和技术措施之间关于利用规避技术措施与反规避技术措施的平衡、网络版权所保护的私人利益与公众利益之间的平衡。WCT、WPPT、ACTA协议规定了网络版权保护与技术措施之间的利益平衡,同时TRIPS协定、ACTA协议也体现权利人的利益与公众利益之间的平衡。对违反规避网络技术措施的行为需要采取刑事立法,国际层面可以依据伞形解决方案来解决。第二章阐述了TRIPS与其他国际条约之间的关联,以试图解释何为解释TRIPS时代以及在TRIPS时代背景中网络版权保护的技术措施问题。第三章分析美国、欧盟、法国和中国这三个代表性的国家和地区有关网络版权保护技术措施的规定。首先分析对比美国DMCA与ACTA中关于网络版权保护技术措施的规定,以及分析美国正在商讨的SOPA草案、PIPA草案体现的TRIPS协定规定的利益平衡问题。其次分析对比欧盟有关指令与ACTA中关于网络版权保护技术措施的规定及侵犯禁止规避技术措施的刑事规定,以及其体现的TRIPS协定的利益平衡。最后比较中国有关的著作权法与ACTA的规定以及实施TRIPS协定的利益平衡问题。第四章针对我国网络著作权保护问题提出建议。我国除了应该遵循TRIPS时代所保护的国际法精神之外,也应该缓和ACTA协议带来的冲击,同时完善违反禁止规避技术措施的刑事立法规定。
[Abstract]:The purpose of this paper is to study the technical measures of network copyright protection in the TRIPS era, which is divided into four chapters. The first chapter discusses the balance of interests of network copyright protection, which is reflected in the balance between network copyright protection and technical measures on the use of circumvention technology measures and anti-circumvention technology measures. The balance between private interests and public interests protected by network copyright. WCTT WPPTACTA Agreement provides for a balance of interests between network copyright protection and technical measures. At the same time, the TRIPS agreement also reflects the balance between the interests of the obligee and the public interest. Criminal legislation should be adopted to violate the measures of circumventing network technology, and the international level can be solved according to the umbrella solution. The second chapter expounds the relationship between TRIPS and other international treaties in order to explain what is the era of TRIPS and the technical measures of network copyright protection in the context of TRIPS era. The third chapter analyzes the regulations of the three representative countries and regions, the United States, the European Union, France and China, on the technical measures of network copyright protection. Firstly, it analyzes and compares the technical measures of network copyright protection in DMCA and ACTA of the United States. It also analyzes the balance of interests in the TRIPS agreement embodied in the SOPA draft that the United States is discussing. Secondly, it analyzes and compares the relevant European Union directives and the ACTA regulations on the technical measures of network copyright protection and the violation and prohibition of circumvention. Criminal provisions for technical measures, Finally, the author compares the copyright law of China with the provisions of ACTA and the balance of interests in implementing the TRIPS Agreement. Chapter 4th puts forward some suggestions on the protection of network copyright in China. In addition to following the spirit of international law protected in the era of TRIPS, China should also ease the impact of the ACTA protocol. At the same time, improve the violation of the technical measures to circumvent the criminal legislation.
