南海维权视角内航标管控法律问题研究

【摘要】:当前,南海岛礁主权争端形势严峻,我国需积极运用国际法中解决领土争端的理论有理有据地维护南海权益。作为国际法院领土争议案件裁判规则的有效管控原则适合于成为我国南海维权的理论支撑。有效管控原则以国家权力的有效行使为核心,而国家立法、行政、司法权力构成国家权力的主要方面。本文借助航标这一国际通行的低敏感性海上助航工具,将南海航标管控作为我国践行有效管控原则的体现。既然航标管控以贯彻有效管控原则、彰显国家权力的有效行使为目标,那么航标管控的内容应包括航标相关立法规制、航标行政执法和航标刑事司法保护三方面。然而,现阶段南海航标立法、航标行政执法、航标刑事司法保护三方面存在的缺陷,已经在一定程度上掣肘南海航标管控维权效果的发挥。为了深化南海航标管控对南海维权的促进作用,本文在结合南海海域的特殊性及南海维权现实需求的基础上,为南海航标相关立法、行政执法、刑事司法保护三方面存在的问题提供法律建议,对实践工作中存在的缺陷予以填补,以期通过航标管控切实维护我国南海权益。本文共分为四章。第一章分别论述了以有效管控原则维护南海权益的策略,以及航标管控与有效管控原则之间的关系,建立了航标管控与南海维权之间的有机联系。第二章通过对比航标法律规范及相关法律当中的规定,分析立法中存在的问题与缺陷,并对其予以适当性解决和填补。第三章明确了南海航标执法的特殊性,介绍了南海航标执法主体与内容,通过对比分析现有体制与南海维权目标的不适性,阐述现有南海航标行政执法体制的不合理之处,并提出完善建议。第四章中分析了南海航标刑事司法保护对南海维权的积极意义,然而南海涉航标案件刑事司法审判实践一直处于缺位状态。根据有效管控原则的构成要件,南海航标刑事司法保护应满足有效、长期、公开等三方面要求,本章从三方面入手厘清现阶段南海刑事司法体制的不足之处,并在此基础上为填补南海涉航标案件刑事司法审判的疏漏之处,提出针对性建议。
[Abstract]:At present, the situation of the sovereignty dispute over islands and reefs in the South China Sea is grim. China should actively use the theory of territorial dispute settlement in international law to protect the rights and interests of the South China Sea. As an effective principle of control and control in territorial dispute cases of the International Court of Justice, it is suitable to become the theoretical support for safeguarding the rights of China's rights in the South China Sea. The principle of effective governance is centred on the effective exercise of State authority, The national legislative, administrative and judicial powers constitute the main aspects of state power. Since the aim of navigation mark control is to implement the effective control principle and highlight the effective exercise of state power, the contents of navigation mark control should include the legal regulation of navigation aids. However, at the present stage, there are some defects in the legislation of navigation aids in the South China Sea, the administrative enforcement of navigation marks, and the criminal judicial protection of navigation aids. In order to deepen the role of navigation aids control in promoting the South China Sea rights protection, this paper combines the particularity of the South China Sea waters and the practical needs of the South China Sea rights protection. To provide legal advice for the related legislation, administrative law enforcement and criminal judicial protection in the South China Sea, and to fill in the defects in practice. This paper is divided into four chapters. The first chapter discusses the strategy of maintaining the rights and interests of the South China Sea by the principle of effective control, and the relationship between the control of navigation aids and the principle of effective control. The second chapter analyzes the problems and defects in the legislation by comparing the legal norms of navigation aids and the provisions of relevant laws, and establishing an organic link between the control of navigation aids and the protection of rights in the South China Sea. The third chapter clarifies the particularity of the navigation mark enforcement in the South China Sea, introduces the subject and content of the navigation mark enforcement in the South China Sea, and analyzes the discomfort of the existing system and the goal of safeguarding the rights of the South China Sea by comparing the existing system and the goal of safeguarding the rights of the South China Sea. This paper expounds the irrationality of the existing administrative law enforcement system of navigation aids in the South China Sea, and puts forward some suggestions for perfection. Chapter 4th analyzes the positive significance of the criminal judicial protection of navigation aids in the South China Sea for safeguarding the rights of the South China Sea. However, the criminal judicial practice of navigation aids cases in the South China Sea has been in a state of absence. According to the constitutive elements of the principle of effective control, the criminal judicial protection of navigation aids in the South China Sea should meet the requirements of effective, long-term and open. This chapter begins with three aspects to clarify the deficiencies of the present criminal justice system in the South China Sea and on this basis to fill the gaps in the South China Sea navigation related cases of criminal justice and put forward targeted recommendations.
