我国境外公民保护机制的新思维

【摘要】：随着我国境外公民数量的日益增多,加之受国际地缘政治等因素的影响而导致的各种冲突和非传统威胁,我国现行的境外公民保护机制面临着前所未有的压力和挑战。为了更好地保护我国境外公民的各种权益,我国应当在境外公民保护机制的定位、框架、法律环境以及运行等方面进行重新考量及优化,即在保护机制的定位上由重点保护生命财产安全转向全面保护合法权益,在保护机制的框架上倚仗国家、社团、公民三个层面的支撑,在保护机制的法律环境上体现习惯法的更新和人权化的拓展,在保护机制的运行上体现制度的保障和结构性修补。
[Abstract]:With the increasing number of citizens outside our country, coupled with various conflicts and non-traditional threats caused by factors such as international geopolitics, In order to better protect the rights and interests of foreign citizens, our country should position and frame the protection mechanism of overseas citizens. The legal environment and operation should be reconsidered and optimized, that is to say, the orientation of the protection mechanism should be shifted from protecting life and property safety to fully protecting the legitimate rights and interests, and relying on the state and the community on the framework of the protection mechanism. The three levels of citizen support reflect the renewal of customary law and the expansion of human rights in the legal environment of the protection mechanism, and the guarantee and structural repair of the system in the operation of the protection mechanism.
