论实际承运人的法律地位——从“指导案例51号”切入

【摘要】:实际承运人并非运输合同当事人,相关国际公约和我国法律却规定其对旅客/托运人承担合同责任,这突破了"合同相对性原则"。明确其法律地位,厘清其从事运输的法律关系,是准确适用法律的前提。"指导案例51号"中法院判决实际承运人对旅客承担合同责任,但或许因理论准备不足,论证过程中回避了这一疑难问题,其指导性价值难免受限。相较于履行辅助人,利他合同债务人是实际承运人法律地位的合理解释。实际承运人法律地位的研究对我国国际国内物流大通道建设和"一带一路"战略的实施具有重大现实意义。
[Abstract]:The actual carrier is not a party to the contract of carriage, but the relevant international conventions and the law of our country stipulate that the carrier bears contractual liability to the passenger / shipper, which breaks through the "principle of relativity of contract" and clarifies its legal status. It is a prerequisite for the accurate application of the law to clarify the legal relationship of the carrier engaged in transport. In "guiding case 51", the court ruled that the actual carrier should bear contractual responsibility for the passenger, but perhaps due to inadequate theoretical preparation, the difficult question was avoided in the course of argumentation. Its guiding value is bound to be limited. Altruistic contract debtor is a reasonable explanation of the actual carrier's legal status. The study of the actual carrier's legal status is of great practical significance to the construction of China's international and domestic logistics channels and the implementation of "Belt and Road" strategy.
