关于死刑犯权利保障问题的思考与研究

【摘要】：死刑犯还有没有权利保障,应该有哪些权利保障?这不仅是当事人及其亲属关心的问题,也是在法律、法理和执法实践中需要澄清的重要问题。我国对死刑犯最后的权利保障立法上缺乏制度化的规定,而实践中各个地方不断积极探索,但做法不一,理论上对死刑犯人权保障的研究明显滞后。在世界各国死刑适用人道化发展趋势之下,法学学者应关注中国死刑犯人权保障这一课题,使死刑犯依法享有基本的权利保障,完善法制社会的权利保障体系。
[Abstract]:Does the death penalty convict still have the right to safeguard, what rights should have the safeguard? This is not only a matter of concern to the parties and their relatives, but also an important issue that needs to be clarified in the practice of law, jurisprudence and law enforcement. In practice, various places have been actively exploring, but in different ways, the research on the protection of the human rights of those facing the death penalty is obviously lagging behind in theory. Under the trend of humanization of the application of the death penalty in various countries of the world, Legal scholars should pay close attention to the subject of human rights protection for Chinese prisoners on death row, make them enjoy the basic protection of rights according to law, and perfect the system of protection of rights in the society of legal system.
