知识产权的十大矛盾

【摘要】：文章对"知识产权"的内在特质进行分析,全面地指出了知识产权自身存在的矛盾,即知识产权与公共利益的冲突,知识产品本身的非排他性与知识产权垄断的排他性之间的矛盾,知识产权个人享受与知识产权责任社会承担之间的矛盾,知识产权对知识发展兼具激励性和抑制性的冲突,知识产权权利的享有的表象与资本控制和垄断知识资源的本质的矛盾,知识产权权利和义务的悬殊不对等的纰漏,知识的创造者与知识的利用者的分离的隐患,知识产权中的国家权力与私人权利并行的本质,知识的主观性与相对客观性的矛盾以及无限性与相对有限性的矛盾,知识产权交易价格的随意性和垄断性的危害等。知识产权自身的这些隐性矛盾可能会造成对知识产权正当性的质疑或知识产权性质及保护的再定位,文章并不对这些矛盾提供现实的解决方案,只是作出提醒,只有正确对待这些矛盾,才能更好地完善中国知识产权制度。
[Abstract]:This paper analyzes the inherent characteristics of "intellectual property", and points out the contradiction of intellectual property itself, that is, the conflict between intellectual property and public interest. The contradiction between the non-exclusiveness of intellectual product itself and the monopoly of intellectual property, the contradiction between individual enjoyment of intellectual property and the social responsibility of intellectual property, and the conflict between intellectual property rights and knowledge development is both encouraging and restraining. The contradiction between the representation of intellectual property rights and capital control and monopoly of knowledge resources, the disparity between intellectual property rights and obligations, the hidden danger of separation between the creator of knowledge and the users of knowledge, The essence of state power and private right in intellectual property, the contradiction between subjectivity and relative objectivity of knowledge, and the contradiction between infinity and finiteness, The arbitrariness of intellectual property transaction price and the harm of monopoly, etc. These hidden contradictions of intellectual property rights themselves may lead to questioning the legitimacy of intellectual property rights or repositioning the nature and protection of intellectual property rights. The article does not provide a realistic solution to these contradictions. It is only a reminder that only by correctly treating these contradictions can China's intellectual property system be better perfected.
