金融危机背景下国际金融监管法制变革研究

【摘要】:金融危机以来,尽管中国的金融业受金融危机的影响较小,但仍然存在或潜在的风险仍然时刻提醒我们应从国际金融监管法制的完善对危机做出反思与总结。金融危机对中国既是机遇也是挑战,我们应以此为契机顺应国际上金融业发展的趋势,改革我国的金融业监管体制。 本文在第一部分主要讨论了金融监管的内涵、理论基础、目标、原则、模式、内容、方法等基础理论问题。在回顾了金融危机的演变历程之后,针对后危机时代的特点提出应以常态化、科学化的精神来建立金融监管的长效机制。 本文第二部分回顾了金融危机前金融监管法制概况,梳理了主要经济体和国际组织的金融监管改革措施,并对当今金融监管国内法层面和国际法层面改革中的问题作了评述。 本文第三部分对危机中暴露出的金融监管法制漏洞作了探讨。对于金融效率的过于推崇而忽视金融安全、宏观审慎监管的缺位、监管的内容未适应虚拟经济的要求、监管重叠与监管真空并存、监管套利引发“竞次”以及国际监管协作体系的式微是造就此次危机的原因。 中国的监管模式根植于国内的金融环境,域外的视角提供了经验和教训,需要加上本上的智慧来消化和吸收。本文第四部分集中于如何完善我国的金融监管法律制度这一命题。就金融监管这样一个层次、角度都异常丰富的宏大命题来说,至少应当包括以下方面的内容:第一,立法理念上安全与效率并重,这要求我们仍须将金融创新置于重要的位置。第二,宏观审慎应当于微观机制中体现,否则将成为缺乏制度依托的理念。第三,分业经营与机构监管并非一一对应,而且我国应在控制风险的基础上允许混业经营,并配以功能监管。监管机构的改革并不在于是“一行三会”或其他,而在于是否能以最小的成本取得最大的监管收益,因此在现有体制下加强机构间的权力协调是更好的选择。第四,要加快金融机构破产立法和相关制度的建设,还要特别重视对金融创新产品的风险监管以及信用评级等中介机构的规制。第五,保护消费者的理念是我国监管文化中较为薄弱的,而这已经在证券监管中饱受抨击。应建立系统化的制度对各种情形下的金融消费者予以适当的保护,特别是应借助私人执法机制去充分发挥市场的自我调试作用。第六,加强国际协作并在该协作法律框架的构建中发挥积极作用。
[Abstract]:Since the financial crisis, although China's financial industry is less affected by the financial crisis, but there are still existing or potential risks still remind us that we should reflect on and summarize the crisis from the perfection of the international financial supervision legal system.The financial crisis is not only an opportunity but also a challenge to China. We should take this opportunity to adapt to the development trend of the international financial industry and reform our financial industry supervision system.The first part of this paper mainly discusses the connotation, theoretical basis, objectives, principles, models, contents, methods and other basic theoretical issues of financial supervision.After reviewing the evolution of the financial crisis, the author puts forward that the long-term mechanism of financial supervision should be established in the spirit of normality and scientization in view of the characteristics of the post-crisis era.The second part of this paper reviews the legal situation of financial supervision before the financial crisis, combs the reform measures of financial supervision in major economies and international organizations, and makes a comment on the problems in the reform of financial supervision at the level of domestic law and international law.The third part of this paper discusses the legal loopholes of financial supervision exposed in the crisis.For financial efficiency too much to neglect financial security, macro-prudential supervision of the absence, the content of regulation does not meet the requirements of the virtual economy, regulatory overlap and regulatory vacuum coexist,Regulatory arbitrage triggered the race and the decline of the international regulatory coordination system was the cause of the crisis.China's regulatory model is rooted in the domestic financial environment, the extraterritorial perspective provides experience and lessons, need to add wisdom to digest and absorb.The fourth part focuses on how to perfect the legal system of financial supervision in China.As far as the grand proposition of financial supervision is concerned, we should at least include the following aspects: first, we should attach equal importance to safety and efficiency in legislation, which requires us to still put financial innovation in an important position.Second, macro-prudence should be reflected in micro-mechanism, otherwise, it will become the concept of lack of institutional support.Third, separate operation and institutional supervision are not one-to-one correspondence, and our country should allow mixed operation on the basis of controlling risks, and be accompanied by functional supervision.Regulatory reform is not about "three sessions" or anything else, but about whether maximum regulatory benefits can be achieved at minimal cost, so strengthening institutional coordination under the existing system is a better option.Fourth, we should speed up the construction of bankruptcy legislation and related systems of financial institutions, and pay special attention to the risk supervision of financial innovation products and the regulation of intermediary institutions such as credit rating.Fifth, the concept of consumer protection is weak in China's regulatory culture, which has been criticized in securities regulation.A systematic system should be set up to protect the financial consumers under various circumstances, especially the private law enforcement mechanism should be used to give full play to the self-debugging role of the market.Sixth, strengthen international cooperation and play an active role in the construction of the legal framework.
