我国外派劳务关系法律问题研究

【摘要】:1979年我国走出了对外劳务合作的第一步。随着经济的日益腾飞,我国国际劳务合作的规模迅速扩展,经营主体迅速增加。据商务部统计,2011年我国对外劳务合作派出各类劳务人员45.2万人,较去年同期增加4.1万人,其中承包工程项下派出劳务24.3万人,劳务合作项下派出20.9万人。经过多年的努力国际劳务合作已经成为我国服务贸易的重要环节,然而在现阶段我国的国际劳务合作尚存在许多法律上的盲点、误区,使得外派劳务人员的合法权利无法加以保障,进而严重阻碍了国际劳务合作事业的发展。本文立足当下的法律环境,对外派劳务各方当事人的法律关系进行梳理,与此同时提出相关立法建议以期完善我国国际劳务合作的法律环境,保护各方当事人的利益。 第一部分阐述了詹源高与中海劳务合作公司劳务合同一案的始末,明确本案的争议焦点是双方当事人法律关系的认定并且指出法律适用的重要性。 第二部分首先明晰了外派劳务合作中,外派劳务企业、劳务人员以及境外用工单位三方当事人的法律关系。与此同时指出应当区分外派劳务与我国的劳务派遣。 第三部分从理论上介绍劳务输出合同法律适用的一般原则:意思自治原则和最密切联系原则,进一步探讨我国《法律适用法》的有关规定。 第四部分在以上内容的基础上提出了对我国外派劳务关系的立法构想:即将外派劳务关系中三份合同的法律适用分别加以规定,并提倡将意思自治原则引入劳务输出合同的法律适用中,,最后强调保护弱者原则在法律运用中的体现。
[Abstract]:In 1979, China took the first step in foreign labor cooperation.With the rapid development of economy, the scale of China's international labor cooperation is expanding rapidly, and the main business body is increasing rapidly.According to the statistics of the Ministry of Commerce, China's foreign labor cooperation sent 452000 workers of all kinds in 2011, an increase of 41000 over the same period last year, of which 243000 were dispatched under contracted projects and 209000 under labor cooperation.After years of efforts, international labor cooperation has become an important link in China's service trade. However, at the present stage, there are still many legal blind spots and misunderstandings in our country's international labor cooperation.The legal rights of expatriate labor workers can not be guaranteed, which seriously hinders the development of international labor cooperation.Based on the current legal environment, this paper sorts out the legal relations of the parties involved in foreign labor services, and at the same time puts forward relevant legislative suggestions in order to perfect the legal environment of international labor cooperation in China and protect the interests of the parties concerned.The first part expounds the beginning and end of the contract case between Zhan Yuangao and Zhonghai Labor Cooperation Company, and clarifies that the focus of the dispute in this case is the confirmation of the legal relationship between the two parties and points out the importance of the application of the law.The second part firstly clarifies the legal relationship of the foreign labor service enterprises, labor service personnel and overseas employment units.At the same time, it is pointed out that we should distinguish between the foreign labor service and the labor dispatch of our country.The third part theoretically introduces the general principles of the legal application of labor export contracts: the principle of autonomy of will and the principle of closest connection, and further discusses the relevant provisions of the applicable Law of Law of our country.The fourth part, based on the above contents, puts forward the legislative conception of the foreign labor relations in our country: that is, the legal application of the three contracts in the foreign assignment labor relations shall be stipulated separately.It also advocates to introduce the principle of autonomy of will into the legal application of labor export contracts, and finally emphasizes the embodiment of the principle of protection of the weak in the application of the law.
