外空旅游相关国际条约的完善

【摘要】：从人类踏入外空开始，外空旅游就成为人们热议的话题。国际上，人们渴望参与外空旅游的热情一直不减。但是有关外空旅游的法律规定却很滞后，有很多法律问题亟待解决。随着航天科技的不断发展，人类向外空迈进的步伐也越来越快，尤其是载人航天技术的突破，使得人类能够自由来去外层空间。人类越来越对外空旅游感兴趣，外层空间的立法，尤其是关于外空旅游的立法，对于这个新兴的领域来说就越发显得重要。本文以规范外空活动的三个主要条约为切入点展开论述，通过对外空旅游产生的背景的分析以及对国内外在这一领域的比较研究，确定研究的范围。分析这三个条约在规范外空旅游活动中的地位和作用，并对《责任公约》以及《外空条约》和《登记公约》中所涉及的国家责任问题、损害赔偿问题和登记制度等进行深入的探讨。在此基础上，，进一步分析条约中存在的未决的问题，从而明确规范外空旅游活动的必要性。并积极探讨当前情况下，解决条约中存在的问题的办法，在各方的努力下，完善对这一领域的规制，包括国际司法机构在这一领域所能起到的作用，以及内国法在这一问题上的补充。最后，为能使外空旅游有着更好的发展空间，提出解决条约中存在的问题的构想，积极加强国家间的合作，并制定统一的专门来规范外空旅游活动的立法，建立自己特有的争端解决机制。同时，我国作为航天大国，未来也很有可能成为外空旅游大国，随着天宫一号与神舟九号载人交会对接任务的顺利完成，我国在建立空间站方面也具备了条件。对于外空旅游所涉及条约中的相关规定也应积极配合，给出我们的立法对策，以促进外空旅游事业的发展。因此，当前情况下，对于外空旅游相关条约问题进行研究是十分有必要。
[Abstract]:From the beginning of human stepping into outer space, outer space tourism has become a hot topic.Internationally, people's desire to participate in outer space tourism has been unabated.However, the legal provisions on outer space tourism lag behind, and there are many legal problems to be solved.With the continuous development of space science and technology, the pace of mankind to outer space is also faster and faster, especially the breakthrough of manned space technology, so that human beings can freely come and go to and from outer space.Human beings are becoming more and more interested in outer space tourism, and the legislation of outer space, especially the legislation on outer space tourism, is becoming more and more important for this new field.In this paper, three major treaties regulating outer space activities are taken as the starting point, and the scope of the study is determined through the analysis of the background of outer space tourism and the comparative research in this field at home and abroad.Analysing the status and role of the three treaties in regulating outer space tourism activities and the question of State responsibility in relation to the liability Convention, the Outer Space Treaty and the Registration Convention,The problem of compensation for damages and the registration system are discussed in depth.On the basis of this, the unsolved problems in the treaty are further analyzed, and the necessity of standardizing outer space tourism activities is clarified.And actively explore, under the present circumstances, solutions to the problems existing in the Treaty and, with the efforts of all parties, to improve the regulation in this area, including the role that international judicial bodies can play in this field,And the supplement of internal law on this issue.Finally, in order to provide better space for the development of outer space tourism, the idea of solving the problems existing in the treaty is put forward, cooperation among States is actively strengthened and unified legislation specifically regulating outer space tourism activities is formulated.Establish its own unique dispute settlement mechanism.At the same time, as a great spaceflight country, China is likely to become a big space tourism country in the future. With the successful completion of the manned rendezvous and docking mission between Tiangong-1 and Shenzhou-9, China also has the conditions for the establishment of the space station.In order to promote the development of outer space tourism, we should actively cooperate with the relevant provisions of the treaties on outer space tourism and put forward our legislative countermeasures to promote the development of outer space tourism.Therefore, in the current situation, it is necessary to study the treaties related to outer space tourism.
