网络攻击构成“使用武力”的判定——对《联合国宪章》第2条第4款的阐释

【摘要】：按照当前网络技术的发展程度,由国家针对他国发动的网络攻击已经具备构成《联合国宪章》第2条第4款规定的"使用武力"的可能性。尽管如此,一起网络攻击是否能够构成"使用武力",难以完全根据现有国际法的理论进行判定。因此国际社会有必要考量是否应当在坚持《联合国宪章》禁止使用武力的基本宗旨及精神的前提下,立足于网络攻击的特殊性质而专门构建一种适用于国际性网络攻击判定的规范体系。
[Abstract]:According to the degree of development of the Internet technology, by the state for his country's cyber attack has constituted < fourth > second the provisions of the Charter of the United Nations "use of force" possibility. Nevertheless, if a cyber attack can constitute a "use of force", it is difficult to complete according to the existing international law theory to judge. It is necessary for the international community to consider whether it should be based on the basic purpose and spirit of adhering to the "Charter of the United Nations on the prohibition of the use of force under the special nature based on network attacks and specially constructed for international network attack system.
