【摘要】：我国从1995年开始政府采购的试点工作,2003年1月1日我国《政府采购法》正式施行,随着我国政府采购额的逐年持续增长以及社会主义市场经济的发展,在2010年7月9日,我国再次向WTO政府采购委员会提出加入《政府采购协定》的申请,虽然至今已取得令人满意的成效,但由于我国这一制度起步晚,仍存在许多需要改进的方面。现阶段对于政府采购法律制度的研究,在理论上可以深化和拓展我国对政府采购理论的研究,从实践上看可以完善我国的政府采购法律制度和相关的机制,为我国政府采购的良性发展和即将加入WTO的政府采购的市场提供制度保障。本文通过以我国政府采购法律制度与WTO政府采购协定、欧盟和美国的政府采购法律制度的比较与分析,提出了改革与完善我国政府采购法律制度的一些建议。本文研究的思路是首先对于政府采购的一般问题进行基本分析,在澄清和深化一些基本理论问题之后,再分析欧盟和美国的政府采购法律制度,充分借鉴理论和实践成果,结合现阶段我国政府采购理论和实践的具体情况,分析我国政府采购法律制度存在的问题和不足,提出完善和健全的建议,以推动我国政府采购法律制度的发展。本论文的结构安排包括绪论、主体部分和结语。第一部分,从理论上对政府采购的法律规制进行了具体阐述。第二部分,对WTO政府采购协定进行概述。第三部分,第四部分,对我国的政府采购做了深入介绍和评析并介绍了欧盟、美国政府采购的相关制度,并在此基础上总结可供我国借鉴的模式。第四部分,分析我国加入WTO政府采购协定后产生的利与弊,并结合世界各地区的政府采购情况借鉴相应模式,总结立法建议。
[Abstract]:China began the pilot work of government procurement in 1995, and on January 1, 2003, the Law on Government Procurement came into effect. With the continuous increase of the amount of government procurement and the development of the socialist market economy, on July 9, 2010, the government procurement of our country was carried out. Our country once again applied to the WTO Government Procurement Committee to join the Agreement on Government Procurement. Although it has achieved satisfactory results up to now, there are still many aspects that need to be improved because of the late start of this system in our country. At the present stage, the research on the legal system of government procurement can theoretically deepen and expand the research on the theory of government procurement in our country, and in practice, it can perfect the legal system and related mechanism of government procurement in our country. It provides system guarantee for the benign development of our government procurement and the market of government procurement which will join WTO. Based on the comparison and analysis of the legal system of government procurement between our country and WTO and the legal system of government procurement in EU and USA, this paper puts forward some suggestions to reform and perfect the legal system of government procurement in our country. The idea of this paper is to analyze the general problems of government procurement, to clarify and deepen some basic theoretical problems, and then to analyze the legal system of government procurement in the European Union and the United States, and to draw full lessons from the theoretical and practical results. Combined with the concrete situation of the theory and practice of government procurement in our country at present, this paper analyzes the problems and shortcomings of the legal system of government procurement in our country, and puts forward some suggestions to improve and perfect the legal system of government procurement in order to promote the development of the legal system of government procurement in our country. The structure of this paper includes the introduction, the main part and the conclusion. In the first part, the legal regulation of government procurement is expounded in theory. The second part, the WTO government procurement agreement is summarized. The third part, the fourth part, has made the thorough introduction and the appraisal to our country government procurement, has introduced the European Union, the American government procurement related system, and has summarized the model which can be used for reference by our country on this basis. In the fourth part, the author analyzes the advantages and disadvantages of China's entry into the WTO Agreement on Government Procurement, and sums up the legislative suggestions in light of the relevant modes of government procurement in various regions of the world.
