论国际刑事法院与人权保障——以防止及惩治灭绝种族罪公约适用案为视角

【摘要】：尽管国际刑事法院正式成立的时间不长,但其对国际刑事审判具有重要的意义,尤其在人权保障方面。国际刑事法院在适用《防止及惩治灭绝种族罪公约》的案例表明,其具有裁决严重侵犯人权的行为、执行临时措施以及积极促进国际和平等人权保障功能。但在适用过程中,其仍面临着管辖权受到质疑、国际刑事法院不够普遍、有罪不罚现象依然存在等几个方面的挑战,应采用以下措施加以完善:首先,明确国际法院管辖权;其次,扩大灭绝种族罪的适用范围;再次,强化国际法院执行力。
[Abstract]:Although the International Criminal Court has not been formally established for a long time, it is of great significance to international criminal justice, especially in the field of human rights guarantee. The case of the International Criminal Court in the application of the Convention on the Prevention and punishment of the Crime of Genocide shows that it has the functions of adjudicating gross violations of human rights, enforcing interim measures and actively promoting international peace and other human rights safeguards. However, in the process of application, it still faces the challenge of jurisdiction, the international criminal court is not universal enough, the impunity still exists, and so on. The following measures should be adopted to perfect it: first, clear the jurisdiction of the international court; Second, expand the scope of application of the crime of genocide; thirdly, strengthen the enforcement of the International Court of Justice.
