【摘要】：近半世纪的国际交往实践中,一系列旨在建立国际经济新秩序的决议通过联合国大会被通过,但是此类决议的法律效力和法律性质是众说纷纭、没有同一定论。众所周知,联合国大会是建立国际经济新秩序、维护世界平和的重要工具,探讨联合国大会大所作决议的国际法律效力对当今世界范围内国际经济新秩序的建立和维护世界和平具有重要的现实意义。而本文通过探讨联合国大会决议具有法律效力的深层原因即从法理角度、法律效力的判断标准、影响因素等三个方面分析,并结合科索沃战争、利比亚战争中联合国决议的执行情况,来对联合国大决议的法律效力问题做出说明,以期对联合国决议的国际法效力问题给出一个合理答案。
[Abstract]:In the practice of international communication for nearly half a century, a series of resolutions aimed at establishing a new international economic order have been adopted by the General Assembly of the United Nations. As we all know, the General Assembly of the United Nations is an important instrument for the establishment of a new international economic order and for the maintenance of world peace, It is of great practical significance for the establishment of a new international economic order in the world and the maintenance of world peace to explore the international legal effect of the resolutions made by the United Nations General Assembly. In this paper, the deep reasons why the UN General Assembly resolutions have legal effect are analyzed from the angle of legal theory, the judgment standard of legal effect, the influencing factors, and combined with the Kosovo War. The implementation of the United Nations resolutions in the Libyan War is intended to explain the legal effect of the United Nations resolutions in order to give a reasonable answer to the legal effects of the United Nations resolutions.
