【摘要】：为了顺应时代的潮流，中国积极寻求区域经济合作，CAFTA便是在这一背景下产生的，它是世界上第一个基本由发展中国家组成的自由贸易区，也是中国区域合作中发展最快且最有成就的。保障措施是各国家保护其国内产业利益的一种重要手段，在国际贸易与区域贸易中，，可以促进各成员国很好地处理贸易自由化与本国产业发展的矛盾问题。CAFTA的保障措施制度是在WTO保障措施制度的基础上，根据CAFTA区域内的具体实践，针对区域内WTO成员与非WTO成员制定的有针对性的保障措施制度。本文主要通过剖析CAFTA区域内签订的各项协定中所涉及的保障措施条款，并对比WTO与NAFTA区域内的相关协定，指出目前CAFTA保障措施制度存在的问题，在此基础上，提出中国将来在制定各区域贸易协定中保障措施制度方面的完善建议。本文主要由引言和正文构成：引言部分，通过介绍CAFTA区域内经济以及其制度发展的情况，论述CAFTA保障措施制度存在的必要性与现实性，以及本文研究CAFTA保障措施的理论意义与实践意义，最后介绍了本文的研究方法。第一部分阐述了CAFTA保障措施的界定、立法依据和采取的模式。通过分析保障措施的理论定义，根据CAFTA保障措施制定的相关法律依据，对CAFTA保障制度进行分类与界定，通过总结区域贸易安排中保障措施采取的模式，并借鉴NAFTA的规定，提出了CAFTA保障措施的模式。第二部分重点分析了CAFTA关于货物贸易的全球保障措施。CAFTA货物贸易全球保障措施的适用对象是CAFTA区域内作为WTO成员方的CAFTA缔约国的措施，实施的依据是GATT1994第19条与WTO保障措施协定。关于CAFTA全球保障措施的内容，主要包括实施条件、实施程序与具体的实施，从而提出了CAFTA全球保障措施存在的问题，以及滥用全球保障措施的救济手段。第三部分重点分析了CAFTA关于货物贸易的双边保障措施。CAFTA双边保障措施的法律依据是CAFTA货物贸易协议的保障措施条款，这一保障措施制度是通过与CAFTA全球保障措施进行比较，制定的具有CAFTA区域特色的双边保障制度，内容包括其实施条件与程序等。在论述双边保障措施时，与NAFTA的规定进行比较，指出其中存在的问题并提出了完善措施。针对滥用双边保障措施的情况，总结了CAFTA可采取的救济手段，并针对区域内的情况，指出了不足并提出完善建议。第四部分重点分析了CAFTA服务贸易的紧急保障措施。针对GATS的具体实际，以及目前服务贸易紧急保障措施多边谈判的情况，制定了CAFTA服务贸易保障措施制度，主要体现在CAFTA服务贸易协议的保障措施条款中，提出了如何适用GATS谈判结果的问题，并规定了在GATS多边谈判完成之前，CAFTA区域内临时性保障措施的内容。
[Abstract]:In order to conform to the trend of the times, China has been actively seeking regional economic cooperation. CAFTA came into being under this background. It is the first free trade area in the world that is basically composed of developing countries. It is also the fastest growing and most successful regional cooperation in China. Safeguards are an important means by which countries protect the interests of their domestic industries, in international and regional trade, The safeguard measures system of WTO is based on the system of WTO safeguard measures, according to the specific practice in the CAFTA region. Aiming at the WTO member and non-WTO member in the region, the corresponding safeguard system is established. By analyzing the safeguards clauses in the agreements signed in the CAFTA region, and comparing the relevant agreements between WTO and NAFTA, this paper points out the problems existing in the current CAFTA safeguards system, on the basis of which, Some suggestions on how to improve the system of safeguard measures in regional trade agreements in the future are put forward. This paper is mainly composed of introduction and text: In the introduction part, by introducing the economy in CAFTA area and the development of its system, the necessity and reality of the existence of CAFTA safeguard measure system are discussed, and the theoretical and practical significance of the study of CAFTA safeguard measure is also discussed in this paper. Finally, the research method of this paper is introduced. The first part expounds the definition, legislative basis and mode of CAFTA safeguard measures. By analyzing the theoretical definition of safeguard measures, according to the relevant legal basis of CAFTA safeguard measures, this paper classifies and defines the safeguard system of CAFTA, summarizes the models adopted by safeguard measures in regional trade arrangements, and draws lessons from the provisions of NAFTA. The mode of CAFTA safeguard measures is put forward. The second part focuses on the analysis of CAFTA's global safeguard measures on the trade of goods. The objects of the application of the global safeguard measures of CAFTA trade in goods are the measures of the CAFTA Contracting States that are members of WTO in the CAFTA region. Implementation is based on Article 19 of the GATT1994 and the WTO safeguards Agreement. The content of the CAFTA global safeguard measures mainly includes the implementation condition, the implementation procedure and the concrete implementation, thus proposed the CAFTA global safeguard measure existence question, as well as the abuse global safeguard measure relief method. The third part focuses on the analysis of the CAFTA bilateral safeguard measures on goods trade. The legal basis of the bilateral safeguard measures of the CAFTA is the safeguard provisions of the CAFTA Agreement on Trade in goods. This safeguard system is compared with the global safeguard measures of the CAFTA. The bilateral safeguard system with CAFTA regional characteristics, including its implementation conditions and procedures. In this paper, the author compares the bilateral safeguard measures with the provisions of NAFTA, points out the existing problems and puts forward some perfect measures. In view of the abuse of bilateral safeguard measures, this paper summarizes the relief measures that CAFTA can take, and points out the deficiencies and puts forward some suggestions for perfection in view of the situation in the region. The fourth part analyzes the emergency safeguard measures of CAFTA service trade. In view of the concrete reality of GATS and the current multilateral negotiation of emergency safeguard measures in service trade, this paper formulates the safeguard measures system of CAFTA services trade, which is mainly embodied in the safeguard measures clause of CAFTA services trade agreement. This paper puts forward the question of how to apply the GATS negotiation result, and sets out the content of the temporary safeguard measures in the GATS region before the multilateral negotiation is completed.
