民族国家的主权权利与知识产权的跨国保护

【摘要】：经济全球化推动了信息交流方式的变革,带动了智力劳动成果物化形式的跨国界流通。根据一个民族国家法律取得的知识产权并不当然获得另一民族国家的法律保护。知识产权严格的地域性特征源自民族国家的主权权利。国家主权的过度强调在很大程度上阻碍了知识产权的跨国保护。一国对知识产权客体的属地管辖权与另一国对知识产权持有人的属人管辖权,或者相反,彼此冲突,长期争斗,必然耗损有限的国际公共资源。让渡管辖权,协调管辖权的冲突必将实现知识产权跨国保护的宏大目标。
[Abstract]:Economic globalization has promoted the change of information exchange mode and the cross-border circulation of intellectual labor fruits materialization. Intellectual property acquired under the laws of one nation state does not necessarily enjoy the legal protection of another nation state. The strict regional characteristic of intellectual property originates from the sovereign right of nation-state. The excessive emphasis on state sovereignty hinders the transnational protection of intellectual property to a large extent. The territorial jurisdiction of one country over the object of intellectual property and the personal jurisdiction of another country over the holder of intellectual property, or the contrary, conflicts with each other and a long struggle, will inevitably consume limited international public resources. The conflict of transferring jurisdiction and coordinating jurisdiction will realize the grand goal of transnational protection of intellectual property rights.
