海峡两岸投资争端解决机制法律问题研究

【摘要】：因台湾地区针对大陆地区人民的投资许可法规与2009年才予出台,两岸投资交流“双向性”的特点还不明显但却绝对可以预见,故而学界关于投资争端解决机制的论述还不多,在“国际”层面的论述就更少。目前两岸正在酝酿“经济合作框架协议”(ECFA)的构建,投资必将成为其中很重要的一部分内容,投资争端解决机制将是重中之重。本文先论述两岸构建自由贸易协定的必要性以及可行性,进而阐述构建投资争端解决机制的基本内容包括基本原则与借鉴NAFTA的原因,以及其具体内容包括解决私人与对方政府间投资争端解决机制的构建与双方政府间投资争端解决机制的构建。需要特别说明的是,由于私人间的投资争端一般仅涉及私人利益,以现有机制已基本可以应对,故而本文对此方面将不予涉及。
[Abstract]:Since the Taiwan region's investment licensing laws and regulations for the people of the mainland were only promulgated in 2009, the characteristics of cross-strait investment exchanges as "bidirectional" are not obvious but absolutely predictable. Therefore, there is not much academic discussion on the investment dispute settlement mechanism. There is even less discussion at the "international" level. At present, the construction of "Economic Cooperation Framework Agreement" (ECFAA) is brewing between the two sides of the Taiwan Strait, and investment will become a very important part of it, and the settlement mechanism of investment disputes will be the top priority. This paper first discusses the necessity and feasibility of establishing a free trade agreement between the two sides of the Taiwan Strait, and then expounds the basic contents of the investment dispute settlement mechanism, including the basic principles and the reasons for drawing lessons from NAFTA. And its concrete contents include the construction of the settlement mechanism of the investment dispute between the private and the other government and the construction of the settlement mechanism of the investment dispute between the two governments. It should be noted in particular that since investment disputes between private individuals generally involve only private interests, the existing mechanism can be basically dealt with, so this article will not deal with this aspect.
