时事新闻保护问题研究

【摘要】：中国著作权法自颁布以来,历经修改,然而对于“时事新闻不受著作权法保护”的认识却似乎一直根深蒂固。对于时事新闻概念的内涵和外延,新闻学界和法学学术界各有自己的说法,没有形成一个统一的概念界定。2002年国务院实施的《著作权法实施条例》第5条规定:“时事新闻,是通过电视台、报纸、期刊、广播电台等媒体报道的单纯事实消息。”新闻学界及实务界普遍把时事新闻界定为电视台、报纸、广播电台、网络等媒体-对各类社会新近发生事件的采访报道。法学界和新闻界对时事新闻的界定存在不小差异。由于著作权法对时事新闻保护规定不完善,实践中出现了众多媒体为节省成本,提高收视率、收听率、发行率、点击率等,对时事新闻作品进行侵权转载,导致时事新闻首家报道媒体权益受到损害。且极易形成一个恶性循环,独家首家时事新闻被侵权转载的越多,愿意投入物力人力挖掘采写独家首家新闻的媒体就越少。公众信息获取权的实现也因此受到负面影响。为更好的保障公众信息获取权,保护挖掘采写独家首家时事新闻媒体的合法权益,本文通过厘析时事新闻概念,论证了时事新闻保护的必要性,并就如何更好的保护时事新闻提出了自己的建议。本文利用分析比较法、实例论证法和解释学等方法,对时事新闻的保护进行了讨论。除了开头部门的引言和末尾的结语外,本文的主体包括四个部分。第一部分探讨了时事新闻在法学领域和新闻学领域的内涵和外延,并就时事新闻的概念提出了自己的观点。第二部分讨论了时事新闻保护的必要性。第三部分分别从反不正当竞争法和著作权法的角度对时事新闻的保护模式进行了分析。对比了《伯尔尼保护文学和艺术作品公约》,以及美国、德国、意大利、日本、英国等国家对时事新闻保护保护的相关规定,介绍分析其可借鉴的部分,并对时事新闻不受著作权保护的众多解释进行了剖析评价。第四部分检讨了我国目前对时事新闻的保护现状,指出了其不足,并就其完善提出了自己的建议。
[Abstract]:China's copyright law has been amended since its promulgation, but the understanding that current affairs news is not protected by copyright law has always been deeply rooted. As to the connotation and extension of the concept of current affairs news, both the journalism and the legal academic circles have their own views and have not formed a unified definition of the concept. Article 5 of the regulations on the implementation of the copyright Law implemented by the State Council in 2002 stipulates: "current affairs news, It is pure factual news reported by television, newspapers, periodicals, radio stations, and so on. " Current affairs news is generally defined as TV station, newspaper, radio station, network and so on in the field of journalism and practice. There is no small difference in the definition of current affairs news between the legal circles and the press. Due to the imperfect provisions of the copyright Law on the protection of current affairs news, in practice, a large number of media, in order to save costs, increase ratings, listen to, distribute, click, and so on, have infringed and reprinted current affairs news works. As a result, current affairs news first reported media rights and interests were damaged. And it is easy to form a vicious circle, the more exclusive news is reproduced by infringement, the less the media will be willing to invest manpower to read and write the first exclusive news. The realization of public access to information is therefore adversely affected. In order to better protect the public's right to obtain information and protect the legitimate rights and interests of the first exclusive news media, this paper demonstrates the necessity of the protection of current affairs news by analyzing the concept of current affairs news. And how to better protect current affairs news put forward own suggestion. This paper discusses the protection of current affairs news by means of analytical comparison, case study and hermeneutics. In addition to the introduction of the beginning and the end of the conclusion, the main body of this paper consists of four parts. The first part discusses the connotation and extension of current affairs news in the field of law and journalism, and puts forward its own views on the concept of current affairs news. The second part discusses the necessity of news protection. The third part analyzes the protection mode of current news from the angle of anti-unfair competition law and copyright law. By comparing the Berne Convention for the Protection of Literary and artistic works and the relevant provisions of the United States, Germany, Italy, Japan, Britain and other countries on the protection of current affairs news, this paper introduces and analyzes the parts that can be used for reference. At the same time, it analyzes and evaluates the many interpretations of current affairs news which are not protected by copyright. The fourth part reviews the current situation of China's protection of current news, points out its shortcomings, and puts forward its own suggestions on its perfection.
