海上人工岛屿的国际法规制

【摘要】:中国在南海诸岛填海、扩建机场等陆地设施引发国际社会广泛关注,以UNCLOS为首的国际法对于海上人工岛屿并没有明确的定义,导致人工岛屿的概念适用模糊。海上人工岛屿具有受国际法与国内法双重调整的法律特征,但其权利义务边界尚不明确,人工岛屿能否作为领海划界的依据存在争议。通过对人工岛屿的分类讨论,明确海上人工岛屿具有的权利、义务边界阈值,根据人工岛屿修建的基础判断其能否作为划界的基础。我国在南海进行的人工岛屿修建符合国际法规定,在海上人工岛屿概念的解释中我国应发挥更大话语权,并通过制订《海洋基本法》为修建海上人工岛屿提供国内法依据。
[Abstract]:China's reclamation in the South China Sea Islands, the expansion of the airport and other land facilities have aroused wide attention from the international community. The international law, led by the UNCLOS, has no definite definition for the artificial islands of the sea, which leads to the fuzzy concept of artificial islands. The artificial islands of the sea have the legal characteristics of the double adjustment of international law and domestic law, but their rights and obligations are under the edge of the law. It is not clear that whether the artificial islands can be demarcated as the boundary of the territorial sea is controversial. Through the classification and discussion of the artificial islands, the rights of the artificial islands on the sea, the threshold of the compulsory boundary, and the basis of the construction of artificial islands, can be judged as the basis for the demarcation. It is stipulated that in the interpretation of the concept of artificial islands on the sea, our country should give full play to the right to speak more language, and to provide the basis for the construction of the artificial islands of the sea by formulating the basic law of the sea.
