知识产权国际强保护的最新发展——《跨太平洋伙伴关系协定》知识产权主要内容及几点思考

【摘要】：当前,《跨太平洋伙伴关系协定》(TPP)正在美国、智利、秘鲁、新西兰、澳大利亚、马来西亚、文莱、越南和新加坡9个国家间进行,目前已完成了7轮谈判。美国提出要将TPP打造成21世纪自由贸易区的典范,仅知识产权一章,内容就长达38页,涉及到商标、地理标志、专利、互联网域名、著作权及邻接权、加密卫星和电缆信号节目、农业化学品、药品数据、商业秘密等众多知识产权客体。它将众多知识产权国际公约与有关国家知识产权保护的"最佳实践"相结合,详细规定了有关知识产权客体的管理和执法保护内容。这既预示了当今全球知识产权保护发展的最新方向,也彰显出当今知识产权国际强保护的进一步发展。跟踪研究TPP中有关知识产权内容,不仅有利于从理论上探究知识产权保护发展趋势,而且还有利于比较分析我国现行知识产权制度,在适应建设创新型国家的前提下,进一步推动我国知识产权事业的健康发展。
[Abstract]:Currently, the Trans-Pacific Partnership Agreement (TPP) is under way among nine countries in the United States, Chile, Peru, New Zealand, Australia, Malaysia, Brunei, Vietnam and Singapore, and has now completed seven rounds of negotiations. The United States has proposed to make TPP a model for a free trade zone in the 21st century. The intellectual property chapter alone, which covers 38 pages, covers trademarks, geographical indications, patents, Internet domain names, copyright and neighboring rights. Encrypted satellite and cable signal programs, agricultural chemicals, drug data, trade secrets and many other intellectual property objects. It combines many international conventions on intellectual property rights with "best practices" of national intellectual property rights protection, and specifies the contents of management and enforcement of intellectual property rights in detail. This not only indicates the latest direction of the development of intellectual property protection in the world, but also highlights the further development of the international strong protection of intellectual property. It is not only helpful to explore the development trend of intellectual property protection in theory, but also to compare and analyze the current intellectual property system of our country under the premise of adapting to the construction of innovative country. We will further promote the healthy development of intellectual property rights in China.
