【摘要】：今年是我国加入世界贸易组织的第十三年,随着我国企业在国际市场上竞争力的日益增强,我国对外贸易规模一直处于稳步增长状态。但由此带来的巨大贸易顺差却使我国与主要贸易伙伴之间频频发生贸易摩擦,而频发的贸易摩擦又在很大程度上对我国对外贸易造成了巨大的损害。对外贸易壁垒调查制度作为我国贸易救济体系中一项攻守兼备的贸易救济措施,今后将会在日益严峻的国际贸易环境中为维护我国合法的贸易利益继续发挥重要的作用。本文将从我国对外贸易壁垒调查制度的运行现状出发,对其现有的制度缺陷进行归纳,并对该缺陷产生的原因进行分析。在此基础上,结合美国和欧盟的相关立法和实践来探讨我国今后在改进对外贸易壁垒调查制度方面的对策,以期能够为我国对外贸易壁垒调查制度的完善提出切实可行的建议。本文除引言和结语外,主体部分主要内容如下：第一部分：贸易壁垒调查制度框架和功能的概述。本部分将通过对贸易壁垒调查制度的开创者美国“301条款”和欧盟《贸易壁垒条例》的分析,来对我国对外贸易壁垒调查制度的内涵、制度设计与功能做简要性介绍。第二部分：介绍我国对外贸易壁垒调查制度的创建。本部分将透过全球经济环境和法律背景去探索我国对外贸易壁垒调查制度的创建原因,介绍贸易壁垒调查制度在我国特殊国情下的具体设计及其在我国对外贸易中发挥的作用。第三部分：分析我国对外贸易壁垒调查制度的现有缺陷。通过结合我国在对外贸易壁垒调查制度建立后所发生的案件以及现行的法律法规来评析我国对外贸易壁垒调查制度的现状,并将其与美欧的制度设计进行对比,总结我国对外贸易壁垒调查制度在实体和程序方面所存在的问题。第四部分：我国对外贸易壁垒调查制度的完善建议。基于第三部分对我国对外贸易壁垒调查制度不足之处的分析,本部分将借鉴美国和欧盟的经验,结合我国国情提出相对具体的改进建议,以求从立法、程序设计、政府职能、行业组织、企业自身五个方面完善我国对外贸易壁垒调查制度。
[Abstract]:This year is the thirteenth year of China's entry into WTO. With the increasing competitiveness of Chinese enterprises in the international market, the scale of China's foreign trade has been steadily increasing. However, the huge trade surplus resulted in frequent trade frictions between China and its main trading partners, and the frequent trade frictions caused great damage to China's foreign trade to a great extent. As an offensive and defensive trade relief measure in China's trade relief system, the investigation system of foreign trade barriers will continue to play an important role in safeguarding China's legitimate trade interests in the increasingly severe international trade environment. This article will proceed from our country foreign trade barrier investigation system movement present situation, to its present system flaw carries on the induction, and carries on the analysis to the reason which the flaw produces. On this basis, combined with the relevant legislation and practice of the United States and the European Union, this paper probes into the countermeasures of improving the investigation system of foreign trade barriers in China in the future, in order to put forward practical suggestions for the perfection of the investigation system of foreign trade barriers in China. Besides introduction and conclusion, the main content of this paper is as follows: the first part: an overview of the framework and functions of trade barriers investigation system. This part will briefly introduce the connotation, system design and function of China's foreign trade barrier investigation system through the analysis of "Section 301" of the United States and the EU "Trade Barrier Regulation", which was the pioneer of the investigation system of trade barriers. The second part: introduce the establishment of our country's foreign trade barrier investigation system. This part will explore the reasons for the establishment of China's foreign trade barrier investigation system through the global economic environment and legal background, and introduce the specific design of the trade barrier investigation system under the special national conditions of our country and its role in China's foreign trade. The third part: analyze the existing defects of our country's foreign trade barrier investigation system. This paper analyzes the current situation of China's foreign trade barrier investigation system by combining the cases that occurred after the establishment of the foreign trade barrier investigation system in China and the current laws and regulations, and compares it with the system design of the United States and Europe. This paper summarizes the problems existing in the investigation system of China's foreign trade barriers in terms of entity and procedure. The fourth part: the perfect suggestion of our country's foreign trade barrier investigation system. Based on the analysis of the inadequacies of the investigation system of China's foreign trade barriers in the third part, this part will draw lessons from the experience of the United States and the European Union, and put forward relatively specific suggestions for improvement in the light of the national conditions of our country, in order to make legislative, procedural design, and government functions. Industry organizations and enterprises themselves improve the investigation system of China's foreign trade barriers.
