海南航权开放法律制度研究

【摘要】:现代市场经济的发展,全球经济一体化的日益紧密越来越突出,人们之间的联系也迈向高速高效方向发展。航空运输业也顺应着这一需求而不断地发展,但是航空业本身具有其自身的特殊的特点决定了各国各地区需要加大监管力度及制定各方面的措施对航权进行界定、规范、引导等等。航权顾名思义就是航空权利,是一国领空主权密不可分的一部分,各国对航空运输均制订了各自的制度规范及航空运输权的立法规制规范,而我国的航权开放刚起步所以这方面的立法和制度建设还不够完善。海南是我国实行航权开放的试点地区,在充分利用航权开放及航权立法规范化方面还有不够完善之处。本文从客观实际出发,理论结合地方实际特点,运用比较的方法对我国航权开放制度做全面的剖析,针对海南经济特区的地理、经济特点及立法优势进行分析和探讨,包括对比国外航权立法,借鉴有益的经验为发展海南航权开放试点地区的航空及相关产业制度化保障及完善航权开放相关立法研究构建可行性的思路。为推动海南乃至我国航权开放的发展提供法律制度保障。 本文共有四个部分,第一部分对航权的法律属性作全面的概述,在重点讨论航权的法律内涵的基础上介绍航权的类型和法律特点以及航权的具体内容,并就我国目前航权开放和相关航空运输立法规范作大体的介绍。 第二部分为航权的国际法律规制。本部分一共分两个大的方面进行讨论,首先是对国际航权开放的几个重要的公约的阐述,第二是介绍国际航权开放法律实践的相关法律模式和未来发展趋势的展望。 第三部分是海南航权开放法律制度现状。本部分共分为三个小部分。首先介绍海南航权开放对海南经济发展的意义,第二对海南开放航权口前的整体情况与相关立法实践做进一步介绍。最后点出海南航权开放目前存在的法律问题。 最后一部分从海南岛的经济特区立法特点出发结合目前海南航权开放所面临的客观实际问题对航权开放立法提出建设性建议,为加快完善海南航权开放特区立法提供理论基础。
[Abstract]:With the development of modern market economy, the integration of global economy is becoming more and more prominent, and the relationship between people is developing in the direction of high speed and high efficiency. The air transport industry has also been developing in accordance with this demand, but the aviation industry itself has its own special characteristics, which determines that all countries and regions need to strengthen supervision and formulate various measures to define and standardize the air rights. Guide and so on. As the name implies, air rights are inseparable parts of a country's sovereignty over air space. All countries have formulated their own regulations on air transport and legislative regulations on air transport rights. But our country's aviation right opening has just started, so this aspect legislation and the system construction is not perfect. Hainan is a pilot area for the opening of air rights in China, and it is not perfect enough to make full use of the opening of air rights and the standardization of aviation rights legislation. Starting from the objective reality, combining the theory with the local reality, this paper makes a comprehensive analysis of the open system of navigation rights in our country by means of comparative method, and analyzes and discusses the geography, economic characteristics and legislative advantages of Hainan Special Economic Zone. Including the legislation of air rights compared with foreign countries, using useful experience for reference for the development of Hainan aviation and related industries in the pilot areas of institutionalization of aviation and related industries, and improve the feasibility of the relevant legislation on the opening of air rights to build a feasible train of thought. In order to promote the development of Hainan and even China's freedom rights open to provide legal system protection. There are four parts in this paper. The first part gives a comprehensive overview of the legal attributes of air rights, introduces the types and legal characteristics of air rights on the basis of focusing on the legal connotations of air rights, and introduces the specific contents of the rights of navigation. It also gives a general introduction to the opening of air rights and related air transport legislation in China. The second part is the international legal regulation of the right of navigation. This part is divided into two parts: the first is the elaboration of several important conventions on the opening of international air rights, and the second is the introduction of the relevant legal models and the prospect of the future development of the legal practice of international aviation rights opening. The third part is the status quo of Hainan's open navigation rights legal system. This part is divided into three parts. This paper first introduces the significance of Hainan's air traffic rights opening to Hainan's economic development, and second, it further introduces the overall situation and relevant legislative practice before Hainan's opening of air traffic rights. Finally, it points out the legal problems existing in the opening of navigation rights in Hainan. In the last part, based on the characteristics of Hainan Special Economic Zone legislation, the author puts forward some constructive suggestions on the legislation of Hainan Special Economic Zone, which provides a theoretical basis for speeding up the improvement of the legislation of Hainan Special Economic Zone.
