国际货运代理法律制度研究

【摘要】：随着当今世界经济全球化的迅速发展，国际货运代理行业尤其是国际海上货物运输代理行业在国际经济活动中发挥着重要的作用。国际货运代理行业的存在也使得国际贸易得以更加顺利的进行。由于中国的国际货运代理行业起步比发达国家晚，，但是发展的却比较快，因此在实践中，产生了很多问题。本文通过对代理制度的阐述，就国际货运代理的概念进行了分析。对我国国际货运代理人的身份进行了分类，分析了国际货运代理人在实践中以直接代理人、间接代理人或者是以混合身份出现的情形。同时，对中国国际货运代理制度存在的法律问题进行了分析，为完善中国国际货运代理制度提出若干建议。
[Abstract]:With the rapid development of the world economic globalization, the international freight forwarding industry, especially the international freight forwarding industry, plays an important role in international economic activities. The existence of international freight forwarding industry also makes international trade more smooth. Since China's international freight forwarding industry started later than the developed countries, but the development is relatively fast, so in practice, there are many problems. This paper analyzes the concept of international freight forwarder by expounding the agency system. This paper classifies the identity of international freight forwarders in China, and analyzes the situations in which international freight forwarders appear as direct, indirect or mixed agents in practice. At the same time, the legal problems in China's international freight forwarding system are analyzed, and some suggestions for perfecting China's international freight forwarding system are put forward.
