地理标志法律保护模式研究

【摘要】:地理标志作为一类新型的知识产权,已被越来越多的国家所重视。从1883年的《巴黎公约》以来,对于地理标志的保护已经有一百多年的历史。随着实践的不断发展,地理标志保护的相关法律也不断完善。地理标志巨大的社会价值逐渐显现。对于地理标志的保护是大势所趋,我国也必须行动起来,制定完善的法律法规,加强对于地理标志的保护。 本文共有五章。第一章介绍了地理标志保护的基本理论。其中最主要的是关于地理标志的概念问题的探讨。地理标志的概念的问题争论已久。概念的问题起到定分止争的作用,是一个相当重要的问题。本文分析了国际条约对于地理标志概念的界定,比较了地理标志和货源标记、原产地名称的异同,比较认同Trips协议对于地理标志的界定。 第二章介绍了国际条约对于地理标志保护的规定。从中我们可以看出国际条约对于地理标志保护的发展和演进。随着时间推进,人们对于地理标志的认识愈加清晰,对于地理标志的法律保护也不断完善。同时本文也分析了国际条约存在差异的原因,指出利益之争是各国博弈的根本原因。讨论国际条约的规定,一方面我国是Trips协议的成员国,有助于我国更好地履行其国际义务;另一方面可以为我国制定完善地理标志保护的相关法律规定提供借鉴,其中先进的经验值得我们学习。 第三章介绍了地理标志法律保护的模式。共有三种模式,分别是专门法保护模式,商标法保护模式和反不正当竞争法保护模式。三种保护模式各有优劣,不过,相对而言,专门法的保护模式对于地理标志的保护力度更大,更具有优势。当然选择何种保护模式,还要根据各国不同的国情来进行选择,以求最大限度地维护自身的利益。 第四章介绍了我国地理标志保护的现状以及存在的问题。我国目前采用的是商标法的保护模式,同时还有地理标志产品的保护方式。商标法的保护存在着许多不完善的地方,这两种模式之问也存在一定的冲突。在现实中,对于地理标志保护的效果并不理想。 第五章对我国的地理标志保护模式提出了一些建议。笔者认为地理标志的保护模式应该采用专门法的保护模式。因为专门法的保护模式对于地理标志的保护力度更大,有利于地理标志价值的发挥,世界上地理标志资源丰富的国家,大部分都采用专门法的保护模式。我国拥有着丰富的地理标志资源,可以借鉴这些国家的经验,制定专门的地理标志保护法,加强对于地理标志的保护,发挥我国的地理标志资源的社会和经济价值,为我国社会经济的发展做出贡献。
[Abstract]:As a new type of intellectual property, geographical indication has been paid more and more attention by more and more countries. Since the Paris Convention of 1883, the protection of geographical indications has a history of more than 100 years. With the continuous development of practice, the laws related to the protection of geographical indications are constantly improved. The huge social value of geographical indication gradually appears. The protection of geographical indications is the trend of the times, our country must also act, make perfect laws and regulations, strengthen the protection of geographical indications. There are five chapters in this paper. The first chapter introduces the basic theory of geographical indication protection. One of the most important is the discussion of the concept of geographical indications. The concept of geographical indications has been debated for a long time. The problem of concept plays a role of dividing and fighting, it is a very important issue. This paper analyzes the definition of geographical indication in international treaties, compares the similarities and differences between geographical indications and source marks, and names of origin, and agrees with the definition of geographical indications in trips agreement. The second chapter introduces the provisions of international treaties for the protection of geographical indications. From this, we can see the development and evolution of international treaties for the protection of geographical indications. With the development of time, people's understanding of geographical indications is becoming clearer and the legal protection of geographical indications has been improved. At the same time, this paper also analyzes the reasons for the differences in international treaties, and points out that the conflict of interests is the fundamental reason of the game between countries. To discuss the provisions of international treaties, on the one hand, China is a member of the trips Agreement, which is helpful for our country to better fulfill its international obligations; on the other hand, it can provide reference for our country to formulate and perfect the relevant laws and regulations for the protection of geographical indications. Among them the advanced experience is worth us to learn. The third chapter introduces the mode of legal protection of geographical indications. There are three modes: special law protection, trademark law protection and anti-unfair competition law. Each of the three protection modes has its own advantages and disadvantages, however, the protection mode of special law is more powerful and more advantageous to the protection of geographical indications. Of course, what protection mode should be chosen according to different national conditions in order to protect their own interests to the maximum extent. The fourth chapter introduces the status quo and existing problems of geographical indication protection in China. At present, our country adopts the protection mode of trademark law as well as the protection mode of geographical indication products. There are many imperfections in the protection of trademark law, and there are some conflicts between the two models. In reality, the effect of geographical indication protection is not ideal. The fifth chapter puts forward some suggestions on the protection mode of geographical indication in our country. The author thinks that the protection mode of geographical indication should adopt the protection mode of special law. Because the protection mode of special law is more powerful for the protection of geographical indications, which is beneficial to the value of geographical indications, most of the countries with rich resources of geographical indications in the world adopt the protection mode of special law. Our country has abundant geographical indication resources, we can draw lessons from the experience of these countries, formulate special geographical indication protection law, strengthen the protection of geographical indication, and give play to the social and economic value of our country's geographical indication resources.
