商事仲裁程序中调解制度的研究

【摘要】：随着市场经济的发展,主要商业纠纷日益复杂,社会对多样化解决纠纷的需求日益增加。作为一种典型的复合型纠纷解决方式,商事仲裁程序中的调解,因其灵活性、保密性、和谐性以及当事人意思高度自治受到广泛的关注。然而,由于相应规则、制度的缺失和滞后,商事仲裁中调解的缺陷日渐显露,进而阻碍其优势的发挥。因此,为更好地发挥该制度的优势和作用,完善商事仲裁程序中调解制度的相关规则、制度迫在眉睫。本文除了导言和结语,共分为四个部分。导言部分介绍了文章写作的背景、选用CIETAC作为主要研究对象的原因以及文章标题确定的过程。文章的第一部分从“商事仲裁程序中的调解”的界定入手,确定了本文的具体研究范围,并从以CIETAC为代表的中国实践和国际各商事仲裁机构的实践两个角度阐述了如今商事仲裁程序中调解制度的发展趋势。文章的第二部分“商事仲裁中调解程序的比较与借鉴”针对商事仲裁中调解的各个具体程序,将我国的立法和CIETAC仲裁规则与国家上其他国家的立法和各国际商事仲裁机构的规则进行比较、分析、研究和借鉴。这些程序具体包括商事仲裁程序中调解程序的启动、调解主持人的确定、调解的信息披露问题以及调解程序的终结问题。在具体程序的对比研究之后,文章的第三部分探讨了有关“商事仲裁中调解协议的执行效力及其司法监督”的问题,从理论上分析了调解协议在特殊情形下的执行效力问题以及其在司法监督方面与一般仲裁裁决的不同。文章的第四部分,笔者首先介绍了我国商事仲裁程序中调解制度的历来发展和现状,指出我国现有立法的缺陷,并在总结前文的基础上,对我国相关立法的原则和具体规则上提出了自己的思考和建议。
[Abstract]:With the development of market economy, the main commercial disputes are becoming more and more complicated, and the demand for diversified settlement of disputes is increasing day by day. As a typical complex dispute resolution method, mediation in commercial arbitration procedure has received extensive attention because of its flexibility, confidentiality, harmony and a high degree of party autonomy. However, due to the lack and lag of the relevant rules and systems, the defects of mediation in commercial arbitration are gradually revealed, which hinders the exertion of its advantages. Therefore, in order to give full play to the advantages and functions of the system, it is urgent to perfect the relevant rules of the mediation system in the commercial arbitration procedure. In addition to the introduction and conclusion, this paper is divided into four parts. The introduction introduces the background of writing, the reasons of choosing CIETAC as the main research object and the process of determining the title of the article. The first part of the article begins with the definition of "mediation in commercial arbitration proceedings", and determines the specific research scope of this article. The development trend of mediation system in commercial arbitration procedure is expounded from two aspects: the Chinese practice represented by CIETAC and the practice of international commercial arbitration institutions. The second part of the article, "comparison and reference of Conciliation procedure in Commercial Arbitration", aims at each specific procedure of mediation in commercial arbitration. The legislation of our country and CIETAC arbitration rules are compared with the legislation of other countries and the rules of international commercial arbitration institutions. These procedures include the initiation of the conciliation procedure in the commercial arbitration procedure, the determination of the moderator, the disclosure of information and the termination of the conciliation procedure. After the comparative study of specific procedures, the third part of the article discusses the issue of "the enforcement effect of conciliation agreement in commercial arbitration and its judicial supervision". This paper theoretically analyzes the enforcement effect of mediation agreement under special circumstances and its difference from general arbitration award in judicial supervision. In the fourth part of the article, the author first introduces the historical development and present situation of the mediation system in the commercial arbitration procedure of our country, points out the defects of the existing legislation of our country, and on the basis of summarizing the above, The author puts forward his own thoughts and suggestions on the principles and specific rules of the relevant legislation in China.
