承运人交货义务与责任研究

【摘要】:作为海上货物运输活动中的重要参与者之一,承运人在海上货物运输中承担着众多的责任义务,交货义务便是上述义务之一。由于在货物交付阶段参与主体较多,各方利益比较集中,法律关系相对复杂,因此实践中承运人在履行交货义务时往往面临较大的风险,稍有不慎,便会背负巨额赔偿。本文以承运人的交货义务与责任为研究对象,立足于航运实践,借鉴国外的立法经验,旨在完善我国实践中的相关做法,促进货物交付行为的顺利进行,为航运事业的发展贡献微薄之力。 本文共分为五章。 第一章货物交付的基本理论。第一节在对民法中交付含义进行分析的基础之上,明确了海商法下货物交付的概念。第二节通过对相关国际公约的比较分析,阐释了海商法下货物交付义务的法律依据。 第二章承运人交货义务的履行。第一节从定义、识别方法等方面对交货的义务主体——承运人进行分析,同时对实际承运人是否负有交货义务进行了详细的阐述。第二节分析了收货人的定义和不同情形下收货人的识别方法,同时笔者对港口当局不能成为收货人进行了分析。第三节从通知义务的履行、按约定的时间地点交货、凭正本提单交货、按单证记载交货四个方面详细论述了承运人履行交货义务的具体要求。 第三章承运人违反交货义务的责任承担。第一节对承运人迟延交付时的责任承担进行具体分析,分别列举了迟延交付时物质损失和经济损失的赔偿范围以及计算方法等,并且对承运人迟延交付的抗辩进行了列举。第二节是对承运人无单放货时的责任承担进行的分析。其中主要是对无单放货时其他直接经济损失赔偿问题的分析。 第四章承运人交货受阻时的权利救济困境及完善建议。第一节对交货受阻的定义进行界定。第二节具体阐述了承运人在交货受阻时行使法律赋予的救济权利时所遇到的困境。第三节列举了《鹿特丹规则》关于承运人交货受阻时的救济方法的相关规定。第四节对完善我国承运人交货受阻时的救济权利提出建议。 第五章结论。关于完善《海商法》中承运人交货义务与责任的建议。分别从完善对迟延交付的规定、提高责任限额和交货受阻时承运人的救济权利方面提出建议。
[Abstract]:As one of the important participants in the carriage of goods by sea, the carrier bears many obligations of responsibility in the carriage of goods by sea, and the obligation to deliver goods is one of these obligations. Because there are more participants in the stage of delivery of goods, the interests of all parties are more concentrated, and the legal relationship is relatively complex, in practice, the carrier often faces greater risks in performing the obligation of delivery, and if he is a little careless, he will bear a huge amount of compensation. This article takes the carrier's delivery duty and liability as the research object, bases on the shipping practice, draws lessons from the foreign legislation experience, in order to consummate the related practice in our country, promotes the goods delivery behavior smoothly. Contribute to the development of shipping industry. This paper is divided into five chapters. The first chapter is the basic theory of the delivery of goods. The first section clarifies the concept of goods delivery under maritime law on the basis of analyzing the meaning of delivery in civil law. The second section explains the legal basis of the obligation of delivery of goods under maritime law through comparative analysis of relevant international conventions. Chapter II performance of the carrier's obligation to deliver goods. In the first section, the carrier is analyzed in terms of definition and identification method, and whether the actual carrier has the obligation to deliver the goods is elaborated in detail. The second section analyzes the definition of consignee and the identification method of consignee under different circumstances. At the same time, the author analyzes that the port authority can not be the consignee. The third section discusses in detail the specific requirements of the carrier to perform the obligation of delivery from four aspects: the performance of the obligation of notification, the delivery of the goods at the agreed time and place, the delivery of the original bill of lading, and the delivery of goods recorded in the documents. Chapter III the carrier is liable for breach of the obligation of delivery. In the first section, the author makes a concrete analysis of the carrier's liability for late delivery, enumerates the compensation scope of material loss and economic loss and the calculation method respectively, and enumerates the defense of carrier's delay in delivery. The second section is the analysis of the carrier's liability. It mainly analyzes the compensation of other direct economic losses when the goods are released without bill. The fourth chapter is about the remedy dilemma of the carrier's right when the delivery of goods is obstructed and the suggestions to improve it. The first section defines the obstruction of delivery. The second section elaborates the difficulties encountered by the carrier in exercising the relief rights granted by law when the delivery of goods is obstructed. Section III enumerates the Rotterdam rules on the carrier's remedies in case of obstruction of delivery. The fourth section puts forward some suggestions to improve the relief right of the carrier when the delivery of goods in our country is blocked. Chapter V conclusion. Suggestions on perfecting the carrier's obligation and liability to deliver goods in Maritime Law. Suggestions are made on improving the provisions on delay in delivery, raising the limitation of liability and the carrier's right to remedy if delivery is obstructed.
