从“市场准入”到“资源获

【摘要】：相比以往关税与贸易总协定/世界贸易组织实践主要是围绕产品市场准入问题的争议,"中国原材料出口限制措施案"则是世界贸易组织成员围绕资源出口限制问题展开的一场资源获取的"攻防战",体现了全球经济的竞争方式由"市场准入"到"资源获取"的转变。这场"攻防战"不仅提出了出口限制措施在世界贸易组织法上之地位、《关税与贸易总协定》第20条与资源出口限制措施的关系以及新加入成员"超世界贸易组织义务"的解释等一系列在世界贸易组织法上尚待澄清的问题,而且对国际贸易和世界贸易组织法也将产生深远影响。
[Abstract]:Compared with the previous GATT / WTO practice, the dispute mainly revolves around the issue of market access for products, while the case on Export restriction measures for China's Raw Materials is a question of resource export restrictions for members of the World Trade Organization. The "attack and defense war" launched by the paper reflects the change from "market access" to "resource acquisition" in the competitive mode of the global economy. This "offensive and defensive war" not only puts forward the status of export restriction measures in the WTO, the relationship between Article 20 of the General Agreement on tariffs and Trade (GATT) and resource export restriction measures, and the new accession to the "Trans-World Trade Organization" The interpretation of "obligations" and a series of issues that remain to be clarified in the field of the World Trade Organization Act, And will also have a profound impact on international trade and world trade law.
