【摘要】：传统知识国际保护规则以《建立世界知识产权组织公约》和《生物多样性公约》两个国际公约为基础,并经历了不断改进和完善的过程,其公平与正义因素在逐渐加强。自然资源永久主权以及公平合理分享利用惠益的原则与方针,都为解决传统知识的知识产权保护问题确立了指导原则。
[Abstract]:The rules for the international protection of traditional knowledge are based on the two international conventions, the Convention on the Establishment of the World intellectual property Organization (WIPO) and the Convention on Biological Diversity (CBD), and have undergone continuous improvement and improvement. The factors of fairness and justice have been gradually strengthened. The principles and principles of permanent sovereignty over natural resources and equitable and reasonable sharing of the benefits of utilization have established guiding principles for the protection of intellectual property rights of traditional knowledge.
