国际贸易中动物福利壁垒的法律问题研究

【摘要】：随着人类文明的进步和环境保护意识的增强,动物保护和保障动物福利的理念已深入人心。另一方面,由于传统贸易壁垒的逐渐没落,新型的由动物福利引发的贸易摩擦也日渐增多。因此,从法律的角度分析和研究动物福利贸易壁垒有着深刻的现实和理论意义。本文由四个部分组成: 第一部分是对动物福利概念的概述。其中分别介绍了动物福利的法律内涵、发展历史和各国的立法概况,从宏观的角度展现了动物福利立法的悠久历史及其进步意义。第二部分是对动物福利贸易壁垒的概述分析。其中将动物福利贸易壁垒的概念同相类似的概念进行了对比分析,以便进一步明确动物福利贸易壁垒作为一种新型的贸易壁垒的特殊性。并且基于其特殊性阐述了动物福利贸易壁垒产生的原因。第三部分评述了动物福利贸易壁垒在WTO框架下潜在的法律依据和可能被应用的形式。同时依据近年来我国国际贸易中实际案例分析对我国禽畜产业、传统中医药产业和皮毛产业国际贸易的影响。第四部分评析了我国目前动物保护立法状况,其中重点介绍了近期我国动物保护立法发展趋势,并且从国际法和国内法两个层面分别提出应对动物福利贸易壁垒的对策。
[Abstract]:With the progress of human civilization and the enhancement of environmental protection consciousness, the concept of animal protection and protection of animal welfare has been deeply accepted. On the other hand, due to the decline of traditional trade barriers, new trade frictions caused by animal welfare are also increasing. Therefore, it has profound realistic and theoretical significance to analyze and study animal welfare trade barriers from the angle of law. This paper consists of four parts: the first part is an overview of the concept of animal welfare. It introduces the legal connotation of animal welfare, the history of development and the general situation of legislation in various countries, and shows the long history of animal welfare legislation and its progressive significance from the macro point of view. The second part is an overview of animal welfare barriers to trade. The concept of animal welfare trade barriers is compared with similar concepts in order to further clarify the particularity of animal welfare trade barriers as a new type of trade barriers. And on the basis of its particularity elaborated the animal welfare trade barrier causes. The third part reviews the potential legal basis and possible application of animal welfare trade barriers under the WTO framework. At the same time, according to the actual cases of China's international trade in recent years, the impact on China's livestock industry, traditional Chinese medicine industry and fur industry international trade is analyzed. The fourth part analyzes the current situation of animal protection legislation in China, which focuses on the recent development trend of animal protection legislation in China, and puts forward countermeasures to deal with animal welfare trade barriers from the two aspects of international law and domestic law.
