国际法视野中的传染病防治与合作

【摘要】：随着世界各国经济步伐的加快,全球化成为必然,不只是经济、政治的全球化,传染病亦成为了全球关注的焦点。随着交通业的日益发达,人口流动迅速加快,跨界活动增多,生态环境日益恶化,传染病全球化特征日益明显,这正是我们国际传染病防治与合作的主要原因。城市的扩展,农村城市化的兴起,全球化范围的人员和物资的流动,高级抗生素造就的超级耐药细菌和病毒都给当今传染病的国际防治带来了新的难题,人类的种种行为正在为像鼠疫这样“作古”了的病毒提供着各种新的机会。加强国际传染病的防治与合作,利用国际法有效的保护、促进这种合作的顺利进行势在必行。从目前国际立法和我国国内法来看,国际立法中没有完整的一部传染病防治法,大多的只是间接涉及该问题；而我国国内虽然有专门的传染病防治法,但仍然存在着诸多问题,仍需进一步完善。因此,加强传染病防治与合作的国际法方面研究就成为了重点,为了弥补研究的空白,加强我国参与国际传染病防治与合作的力度,对国际传染病的防治与合作的研究有其重要性和特殊性。本文主要是从国际法和中国国内法两方面分析论述当前国际传染病防治与合作的现状、缺陷和不足,并提出了进一步完善的建议。本文突出的创新点是将传染病防治的国际合作问题与人权保护相衔接,揭示了国际立法与中国国内立法中对人权保护的必要性。笔者的写作思路大体如下：首先,从国际传染病防治与合作的原因指出必须进行国际合作；其次,以《国际卫生条例(2005)》与《国际卫生条例(1969)》相比,阐述国际立法对传染病防治的新发展以及国际环境法与传染病防治的关系,同时阐明中国在“非典”后对传染病防治法的完善；再次,从国际立法和中国国内法角度论述在传染病防治过程中的人权保护问题；最后,强调我国应当积极加入到国际传染病的防治与合作中来,并分析其原因,对我国国内法目前传染病防治方面存在的问题加以阐述,进而提出进一步加强国际传染病防治与合作的意见。本文序言部分对国际传染病防治与合作的现状作了简要的引述。介绍了国际传染病的缘起,阐述了传染病防治与合作的重要意义以及立法规制的必要性、紧迫性。本文正文部分主要分为四个部分。首先,介绍了国际传染病防治与合作概述,详尽阐述了国际传染病防治与合作的原因,总结了当前传染病的全球化应对方式,深刻分析了国际传染病防治与合作的必要性。接着,在与前一部分理论分析承接的基础上,本文对目前国际上与传染病防治相关的主要法律进行了分析,介绍了它们的起源、发展以及存在的缺陷。通过分析这些相关法律,深刻剖析中外在国际传染病防治与合作法律制度方面的不足,为如何更好的运用法律手段对传染病进行合理防治提供依据。正是由于国际传染病防治与合作的过程中存在着诸多问题。因此,本文第三部分重点介绍了目前国际传染病防治与合作中存在的主要问题,通过对比国际和中国对该问题的解决现状阐释了进一步完善国际传染病防治与合作在此方面规定的必要性。最后,本文对构建我国传染病防治与国际合作进行了设想。总结了适于我国国情的传染病防治措施,在分析了我国积极参加国际传染病防治与合作的必要性的基础上揭示了当前我国在传染病防治领域中存在的问题,提出了健全我国参与国际传染病防治与合作措施的建议。
[Abstract]:With the rapid economic pace of all countries in the world, globalization is inevitable, not only economic, political globalization, and infectious diseases have also become the focus of global attention. With the increasing development of the transportation industry, the population flow is quickening, the cross-border activities are increasing, the ecological environment is worsening, and the globalization of infectious diseases is becoming more and more obvious, which is our international The main reasons for the prevention and cooperation of infectious diseases, the expansion of the city, the rise of rural urbanization, the flow of people and materials in the global scope, the super antibiotic resistant bacteria and viruses made by advanced antibiotics have brought new problems to the international prevention and control of today's infectious diseases, and the species behavior of human beings is being "ancient" like the plague. It provides all kinds of new opportunities. Strengthening the prevention and cooperation of international infectious diseases, utilizing effective protection of international law and promoting the smooth progress of such cooperation are imperative.
From the current international legislation and China's domestic law, there is not a complete law of prevention and control of infectious diseases in international legislation, most of which are only indirectly related to the problem; although there are special prevention and control laws of infectious diseases in China, there are still many problems and still need to be further improved. Therefore, the international law of prevention and cooperation of infectious diseases should be strengthened. Face research has become the key point. In order to make up the blank of the research, strengthen our country's participation in the prevention and control and cooperation of international infectious diseases, and the study of the prevention and cooperation of international infectious diseases is of its importance and particularity.
This article is mainly from the two aspects of international law and China's domestic law to analyze the current situation, defects and shortcomings of the prevention and cooperation of international communicable diseases, and put forward some suggestions for further improvement. The innovation point of this article is to link the international cooperation with the prevention of infectious diseases with the protection of human rights, and to reveal the international legislation and the domestic legislation in China. The need for the protection of human rights.
The author's writing ideas are as follows: first, international cooperation is pointed out from the reasons of the prevention and cooperation of international infectious diseases. Secondly, the new development of international legislation for the prevention and control of infectious diseases and the relationship between international environmental law and the prevention and control of infectious diseases are expounded in comparison with the international health regulations (2005) and the international health regulations (1969). China has perfected the prevention and control of infectious diseases after "SARS". Again, the protection of human rights in the prevention and control of infectious diseases is discussed from the perspective of international legislation and China's domestic law. Finally, it is emphasized that China should actively join the prevention and control and cooperation of international infectious diseases, and analyze its causes, and prevent and control the current infectious diseases in China's domestic law. The existing problems are expounded, and suggestions for further strengthening international infectious disease prevention and cooperation are put forward.

The text of this article is divided into four parts. First, it introduces the overview of the prevention and cooperation of international infectious diseases, expounds the causes of the prevention and cooperation of international infectious diseases in detail, summarizes the global coping style of the current infectious diseases, and deeply analyzes the necessity of the prevention and cooperation of international infectious diseases.
Then, on the basis of the previous part of the theoretical analysis, this paper analyzes the main laws related to the prevention and control of infectious diseases at present, and introduces their origin, development and existing defects. Through the analysis of these relevant laws, the shortcomings of the legal system of the prevention and cooperation of international communicable diseases and cooperation between China and foreign countries are deeply analyzed. It provides a basis for better use of legal means to prevent and cure communicable diseases.
There are many problems in the process of prevention and control of international infectious diseases. Therefore, the third part of this paper focuses on the main problems in the prevention and control of international communicable diseases. By comparing international and China's current problems, this paper explains the further improvement of international infectious diseases prevention and cooperation in this area. The necessity of the regulation.
In the end, this paper envisages the construction of the prevention and control of infectious diseases and international cooperation in China. It summarizes the prevention and control measures of infectious diseases suitable for the national conditions of our country. On the basis of analyzing the necessity of actively participating in the prevention and control and cooperation of international infectious diseases, it reveals the existing problems in the field of prevention and control of infectious diseases in our country and proposes to improve our country's participation.
