南海岛礁建设与航行和飞越制度的关系

【摘要】：本文共计2.4万字符左右,除摘要、引言、结语之外,本文分为四个部分。引言。合法规制的岛礁建设对于建设良好的通行环境具有非常重要的意义,只有建设良好的通行环境才能够促进国家经济的发展、社会的进步和综合国力的不断提升。海洋航行和飞越制度是《联合国海洋法公约》贯穿始终的基本制度,有航行许可、无害通过、过境通行、群岛海道通过、航行和飞越自由等制度。一、岛礁建设不妨碍航行和飞越自由。合法规制的岛礁建设对于建设良好的通行环境具有非常重要的意义,只有建设良好的通行环境才能够促进国家经济的发展、社会的进步和综合国力的不断提升。二、联合国海洋法公约是如何规定的航行和飞越。海洋航行和飞越制度是《联合国海洋法公约》贯穿始终的基本制度,有许可航行、无害通过、过境通行、群岛海道通过、航行和飞越自由等制度。三、南海航行的现状。南海航行安全目前正面临着日益猖獗的海盗、海上恐怖主义以及外国武装船只活动的威胁。中国在确保南海航行安全领域的行动仍然相对滞后、发挥的作用也非常有限。四、建议保障航行和飞越的制度。我国必须采取诸如加强海上军事力量投入、加强海事执法活动管理、与相关国家积极进行安全合作以及建立地区双边安全合作机制等措施加以应对。结语。南海岛礁建设问题是符合公约规定的,中国对南海岛礁建设具有合法合理性。近年来成为了美国、日本和南海周边国家与中国的南海争端问题,各国都想干涉中国在南海问题上的主权权利,但是中国南海自古以来都是中国不可分割的一部分,中国必须发挥强硬的态度,积极采取措施进行岛礁建设,加强南海航行和飞越制度的积极建设,对于国家利益和国家安防问题不可让步。

The system of maritime navigation and overflight is the basic system throughout the United Nations Convention on the Law of the Sea. It has a navigation permit, innocent passage, transit passage, archipelagic sea lanes passage, freedom of navigation and overflight, and so on. First, the construction of islands and reefs shall not impede freedom of navigation and overflight. The legal regulation of the construction of islands and reefs for the construction of a good environment has very important significance, only the construction of a good environment can promote the development of national economy, social progress and the continuous improvement of comprehensive national strength. Second, how the United Nations Convention on the Law of the Sea is prescribed for navigation and overflights. The system of maritime navigation and overflight is the basic system throughout the United Nations Convention on the Law of the Sea. It has a system of permitted navigation, innocent passage, transit passage, archipelagic sea lanes passage, freedom of navigation and overflight, and so on. Third, the current situation of navigation in the South China Sea. The safety of navigation in the South China Sea is under threat from increasingly rampant pirates, maritime terrorism and foreign armed vessels. China's actions to ensure the safety of navigation in the South China Sea remain relatively slow and play a very limited role. Fourth, to recommend a system to guarantee navigation and overflight. China must take measures such as strengthening the input of maritime military force, strengthening the management of maritime law enforcement activities, actively carrying out security cooperation with relevant countries and establishing regional bilateral security cooperation mechanism. Conclusion The construction of islands and reefs in the South China Sea is in accordance with the provisions of the Convention, and China has legal rationality in the construction of islands and reefs in the South China Sea.
